13251ORDINANCE NO. 13,251 0P,DINANCE OF THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS, VACATING AND CLOSING THE ALLEY IN BLOCK 130, ORIGINAL CITY OF LITTLE ROCK, ARKANSAS. WHEREAS, a petition was duly filed with the Board of Directors of the City of Little Rock, Arkansas, on the 29th day of December, 1976, asking the Board of Directors to vacate and abandon all of the alley in Block 130, Original City of Little Rock, as shown in Bagley Book 56 -38, and as designated on one of the original plats to the City of Little Rock, but which plat has been destroyed or lost and which is no longer on file in the Plat Books in the Office of the Circuit Clerk of Pulaski County, Arkansas, subject, however, to any public utility easements located in said alley WHEREAS, after due notices as required by law, the Board of Directors has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the alley, hereinbefore described, has heretofore been dedicated to the public use as an alley, as herein described; has not been actually used by the public generally for a period of at least five (5) years subsequent to the filing of the plat; that all of the owners of the property abutting upon the alley to be vacated have filed with the Board of Directors their written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such alley; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all its rights, together with with the rights of the public generally, in and to the alley designated as follows: An unnamed alley, measuring approximately 20 feet by 300 feet, located between Arch Street and Gaines Street, running from Eighth Street to Ninth Street, entirely within Block 130, Original City of Little Rock, County of Pulaski, State of Arkansas subject, however, to any public utility easements located in said alley. SECTION 2. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder of Pulaski County and recorded in the Deed Records of the County. SECTION 3.
