3 A RESOLUTION TO AWARD A CONTRACT FOR 13TH STREET AT
4 GAINES STREET AND WRIGHT AVENUE (STATE STREET TO
5 GAINES STREET) DRAINAGE IMPROVEMENTS; AND FOR OTHER
6 PURPOSES.

8 WHEREAS, existing drainage pipes and structures are failing and replacement is warranted; and,
9 WHEREAS, bids were solicited for 13`h Street at Gaines Street and Wright Avenue (State Street to
10 Gaines Street) Drainage Improvements, Bid No. 2012 -258; and,
11 WHEREAS, JCON, Inc., was the lowest responsive and responsible bidder meeting specifications in
12 the amount of Ninety -One Thousand, Eight Hundred Seventy -Four and 20/100 Dollars ($91,874.20),
13 being Eighty -Two Thousand, Five Hundred Twenty -Two Dollars ($82,522.00), plus 10% contingencies.
14 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
15 OF LITTLE ROCK, ARKANSAS:
16 Section 1. The City Manager is hereby authorized to execute an agreement with JCON, Inc., for 13`h
17 Street at Gaines Street and Wright Avenue (State Street to Gaines Street) Drainage Improvements.
18 Section 2. Funding for this project is available from the 2012 % -Cent Capital Sales Tax Project
19 Funds.
20 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
21 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
22 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
23 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
24 resolution.
25 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with
26 the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
27 Section 5. This resolution will be in full force and effect from and after the date of its adoption.
