13342r �f ORDINANCE NO. 13,342 AN ORDINANCE ESTABLISHING THE CENTRAL BUSINESS IMPROVEMENT DISTRICT NO. 2 (UNION STATION) OF THE CITY OF LITTLE ROCK, A RKA NSA S. WHEREAS, parties claiming to be more than two - thirds in value, as shown by the last County assessment, of the owners of the property located within the territory hereinafter described have filed a Petition praying that a Central Business Improvement District be established for the purposes hereinafter set out; and, WHE REAS, after due notice as required by law, the Board of Directors of the City of Little Rock, Arkansas, has heard all parties desiring to be heard, and has ascertained that said Petition was signed by more than two - thirds in value, as shown by the last County assessment, of the owners of real property situated within the said to rritory; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. Establishment of District. There is hereby established a Central Business Improvement District, under the authority of Act 162 of 1973 and Act 402 of 1975, the boundaries of which are as follows: Lots 7, 8 and 9, Block 364, ORIGINAL CITY of Little Rock, Arkansas; and, Part of Block 339; Part of Lots 1 and 12, Block 340; Part of Block 363; and Lots 1, 2 and 3, BARTON'S SUBDIVISION of Block 364, ALL IN ORIGINAL CITY OF LITTLE ROCK; Part of Lots 1, 2, 3 and part of Lots 7 to 12, inclusive, Block 2 and Lots 1 to 6 and part of Lots 7 and 8, Block 1, DEAF MUTE ADDITION to the City of Little Rock; Part of Block 1, WORTHEN'S SUBDIVISION, all lying in W 1/2 of NW 1/4 of Section 3 and E 1/2 of NE 1/4, Section 4, Township 1 North, Range 12 West, described as follows: Beginning at a point on the West right of way line of Victory Street 100 feet southwardly from the southeast corner of Block 339, ORIGINAL CITY OF LITTLE ROCK; thence northwardly along the West right of way line of Victory Street or an extension thereof 401.1 feet; thence southwestwardly by a straight line 1, 329.6 feet, more or less, to a point on the East right of way line of Bishop Street, said point being 61.6 feet northwardly from the Southwest corner of Block 2, DEAF MUTE ADDITION; thence southwardly along the East right of way line of Bishop Street 61.6 feet to the North right of way line of Cherry (also known as Second) Street; thence eastwardly along the North right of way line of Cherry Street 300 feet to the Southeast corner of Block 2, DEAF MUTE ADDITION; thence northwardly along the West right of way line of High Street 62.2 feet, more or less, to a point 68.8 feet southwardly from the North- east corner of Lot 12 in said Block 2; thence northeastwardly 174.3 feet, more or less, to the Northeast corner of Lot 8, Block 1, DEAF MUTE ADDITION; thence Northwardly along an extension of the East line of said Lot 8 for 16 feet to the North line of a 16 foot alley in said Block 1; thence eastwardly along said North line of the 16 foot alley 200 feet to the Southeast corner of Lot 1, Block 1, DEAF MUTE ADDITION; thence northwardly along the East line of said Lot 1, 3.2 feet to the Southwest corner of Lot 3, BARTON'S SUBDIVISION of Block 364, ORIGINAL - 2 - CITY OF LITTLE ROCK; thence eastwardly along the South line of Lots 3, 2 and 1 of said Block 364 for 144.6 feet to the West right of way line of Woodlane Street; thence northwardly along the West right of way line of Woodlane Street 110 feet; thence eastwardly by a straight line 360 feet to the point of beginning, containing 5.6 acres, more or less. Section 2. Powers of the District. Said district is hereby established with all powers necessary or desirable to carry out any and all parts of the plan of improvement including, but not limited to, those enumerated in said Act 162 of 1973 and said Act 402 of 1975 and any subsequent amendments thereto for the express purpose of employing architects,engineers and other professional personnel to prepare plans, specifications and estimates of cost for the construction of improvements in the District and to supervise and inspect such construction and to construct, establish and operate the following: business and professional offices, a pedestrian or shopping mall or malls, plazas, sidewalks, parks, fountains, parking facilities, sidewalk cafes, bus stop shelters, decorative lighting, benches and other seating furniture, sculptures and land- scaping and other decorative planting, pedestrian overpasses and such other improve- ments, facilities, services and equipment as may be authorized by said Act 162 of 1973 and said Act 402 of 1975, all to be located, constructed, operated, and maintained in such manner and with such materials and under such circumstances and conditions as the Commissioners to be selected for said District shall deem for the best interests of the District, and that the cost thereof be assessed and charged upon the real property above described. Further, by resolution of the Board of Commissioners of the District, the District may issue bonds as provided by the Acts of Arkansas, as amended, for the purpose of providing funds to assist in the construction, reconstruction, repair, replacement, renovation or any other restoration or improvement or real and personal property located within the boundaries of the District which, in the opinion of the Board of Commissioners, will further the elimination of urban blight and decay and provide for the modernization and general improvement of the properties within the District. Section 3. Authority to Assess and Collect A Supplemental Annual Assessment. Said district is further empowered to assess and collect a supplemental annual assess- ment at such rates as the Commissioners herein named selected for the district may i ■ �3 - 3 - recommend not to exceed one -half of one per cent (1/2 of 1%) of the assessed benefits for the operation, maintenance, repair and replacement of the improvements to be constructed, as such may from time to time be required, such annual assessment to be subject to adjustment from time to time as provided by law. Section 4. Name of the District. The said Central Business Improvement District shall be known as "Central Business Improvement District No. 2 (Union Station) of the City of Little Rock Arkansas. " Section 5. Appointment of Commissioners. A nn A ldridge, Paul H. Dixon, David Kane, Ken Mitchell and James H. Nettles are hereby named Commissioners.
