13482ORDINANCE 140. 13,482 AN ORDINANCE AMENDING ORDINANCE NO. 13,441 OF THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS, VACATING AND CLOSING THE ALLEY IN BLOCK 95, ORIGINAL CITY OF LITTLE ROCK, ARKANSAS. WHEREAS , a petition was duly filed with the Board of Directors of the City of Little Rock, Arkansas, on the 22nd day of February , 1978 , asking the Board of Directors to vacate and abandon all of the alley in Block 95, Original City of Little Rock, as designated on the certified survey of said property filed with the Little Rock City Clerk, subject, however, to any public easements in said alley; and WHEREAS, after due notices as required by law, the Board of Directors has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the alley, hereinbefore described, has heretofore been dedicated to the public use as an alley, as herein described; has not been actually used by the public generally for a period of at least five (5) years subsequent to the filing of the plat; that all of the owners of the property abutting upon the alley to be vacated have filed with the Board of Directors their written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such alley; NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally; in and to the alley described as follows: A strip of land 20 feet wide running north and south through the middle of Block 95, Original City of Little Rock traversing the entire length of said Block 95 for a distance of 300 feet, more or less, and bounded on the west by Lots 1 through 6, said Block 95, on the south by Capitol Avenue, on the east by Lots 7 through 12, said Block 95 and on the north by Fourth Street. subject, however, to any public utility easements located in said alley. SECTION 2. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder of Pulaski County and recorded in the Deed Records of the County. SECTION 3.
