Now on the 6th day of March, 1978, came on to be
heard the Complaint, the Complaint In Intervention, and the
respective answers thereto, the plaintiffs appearing in
person (except for Madalyn T. Breitake) end by their attorney,
John P. Gill, the defendant appearing by its attorney,
Joseph C. Kemp, and the intervenor appeariny in person and
by his attorney, Paul N. Hickey, and from the testimony of
I witnesses and other evidence introduced, the Court doth find
' that Little Rock Ordinance No. 13,373 1s valid and the alley
described therein is closed. The Court further finds that
Little Rook Ordinance No. 13,39b is void.

No. 13,373 of the City of Little Rock, Arkansas be, and the
84104 is, hereby Qeclared valid and the alley described in
said Ordinance is hereby declared closed to the public.

said Ordinance is hereby declared closed to the public.
IT IS FURTHER ORDERED AND ADJUDGED that Ordinance
No. 13,398 of the City of Little Rock, Arkansas be, and the
same is, hereby declared void.

ORDINANCE NO. 13,398
AN ORDINANCE REPEALING ORDINANCE #13,373 WHICH
VACATED AND CLOSED A PORTION OF THE ALLEY IN
PROSPECT TERRACE ADDITION TO THE CITY OF LITTLE
ROCK; AND FOR OTHER PURPOSES
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE
CITY OF LITTLE ROCK, ARKANSAS
SECTION 1. Ordinance #13,373 passed November 15, 1977 wherein
the City of Little Rock released, vacated and abandoned its rights,
together with the rights of the public generally in and to the alley
described as follows is hereby repealed:
All that part of an Alley or Driveway Easement shown
on-the Plat of Prospect Terrace, Additions to the City
of Little Rock, Arkansas, which lie between Lots 88 and
89, Prospect Terrace on the South and Lots 78 and 77,
Prospect Terrace, and Lot 175, Prospect Terrace No. 2
on the North, subject however, to any public utility
easements located in said alley.
SECTION 2. This Ordinance shall be in full force and effect
from and after its passage.
