14017ORDINANCE NO. 14,017 AN ORDINANCE CALLING A SPECIAL ELECTION ON THE QUESTION OF LEVYING A SALES AMID USE TAX WITHIN THE CITY OF LITTLE ROCK UNDER THE PROVISIONS OF ACT 990 OF 1975 AND ACT 133 OF 1981 FOR THE PURPOSES OF IMPROVEMENT OF MU- NICIPAL SERVICES AND TO INSURE A STABLE SOURCE OF REVE- NUE; PRESCRIBING OTC MATTERS RELATING THERETO; AND DECLARING AN EMERGENCY. WHEREAS, the City of Little Rock, Arkansas (the "City ") is a city of the first class under the laws of the State of Arkansas and is authorized to levy a sales tax pursuant to Act 990 of 1975 as amended by Act 133 of 1981; and WHEREAS, there presently exists an immediate need for the im- provanent of municipal services and for a stable source of revenue to finance such vital local goverment services; NOW, THEREFORE, BE IT ORDAINED by the Board of Directors of the City of Little Rock, Arkansas: Section 1. That a special election be, and the same is hereby called to be held in the City on the 19th day of ay, 1981, at which election there will be submitted to the electors of the City the question of the levy of a city sales and use tax pursuant to the authority pro- vided in Act 990 of 1975 as amended by Act 133 of 1981. Section 2. That the question shall be placed on the ballot for the special election in substantially the following form: Vote on measure by placing an "X" in the square above the measure either for or against: "FOR adoption of a one percent (1 %) local sales and use tax within the city." "AGAINST adoption of a one percent (17.) local sales and use tax within the city." The City of Little Rack has adopted Ordinance No. 14,016 levying a local sales tax of one percent (1 %) within the City. If the electors approve the tax it will be collected in the manner set out in Ark. Stat. Arm. §19 -4514 (Repl.1980), as amended by Act 133 of 1981. Provided, however, that this tax shall not apply to purchases made prior to July 1, 1981. Section 3. That the election shall be held and conducted and the vote canvassed and the results declared under the law and in the Manner now or hereafter provided for municipal elections, so far as the same may be applicable, and the Mayor shall give notice of such election by an advertisement published once a week for four consecutive weeks in a newspaper having a bona fide circulation in Little Rock, Arkansas, with the last publication to be not less than ten (10) days prior to the date of the election, and only qualified electors of Little Rock, Arkansas, shall have the right to vote. Section 4. That the results of said election shall be pro- claimed by the Mayor, and his proclamation shall be published one time in a newspaper having a bona fide circulation in Little Rock, Arkansas, which proclamation shall advise that the results as proclaimed shall be conclusive unless attacked in the courts within thirty (30) days after the date of such proclamation. Section 5. That the Mayor is authorized to advertise said tax in the manner provided for by law. Section 6. That a copy of this Ordinance shall be given to the Pulaski County Board of Election Commissioners so that the necessary election officials and supplies may be provided. Section 7. That there is hereby found and declared to be an imrediate need for a city -wide sales and use tax in order that the City may begin an immediate inmrovement of mmicipal services and to insure a stable source of revenue to finance vital local government services. It is, therefore, declared that an emergency exists and this Ordinance being necessary for the immediate preservation of the public health, safety and welfare, shall be in force and shall take effect immediately upon and after its passage.
