13929ORDINANCE NO. 13,929 AN ORDINANCE AMENDING IN PART SECTIONS 2 AND 3 OF ORDINANCE NO. 11,345 TO PROVIDE FOR LEVYING ADDITIONAL PRIVILEGE TAXES TO BE PAID BY SOUTH- WESTERN BELL TIIM-]ONE COMPANY FOR THE YEAR 1981; PROVIDING FOR THE PAYMENT THEREOF; DECLAR- ING AN EMERGENCY; AND FOR OTHER PURPOSES. WHEREAS, the Southwestern Bell Telephone Company (hereinafter sanetimes referred to as "Telephone Company ") is duly authorized by ordinance to operate its telephone system and all business incidental to or connected with the conduct of a telephone business and system in the City of Little Rock all beneficial to the inhabitants thereof residing in said municipality, and WHEREAS, the Telephone Company is now and will be occupying the streets and alleys of this City for the purpose of operating and maintaining its telephone system and service to the municipality and the inhabitants and customers residing in said municipality; and WHEREAS, the City is entitled to receive just and reasonable taxes fran the Telephone Company which the City may lawfully impose and Telephone Company is entitled to pay; and WHEREAS, that portion of the city revenues derived from the three -mill county road tax is no longer available to the city. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. In addition to the annual privilege tax paid or to be paid to the City of Little Rock by the Southwestern Bell Telephone Company for the privilege of doing business in the City of Little Rock for the year 1981, as provided for by Section 2, Ordinance No. 11,345 dated December 1.7, 1962, there is hereby levied and Southwestern Bell Telephone Company shall pay to the City the sum of One Million Two Hundred Thousand Dollars ($1,200,000), or an amount equal to four and five tenths (4.5 %) percent of the Bell Telephone Company's gross residential, comae - rcial, and industrial telephone revenues as paid to it during the calendar year 1981 by �r 0 residential, carmiercial, and industrial customers located within the corporate limits of the City of Little Rock, or eight (8 %) percent of the Company's basic local service revenues, whichever is greater. SECTION 2. Payments to the City by Southwestern Bell Telephone Company for the net additional taxes as provided for in Section 1 hereof shall be rrade mnthly by the 15th day of each month. SECTION 3. The City recognizes and accepts the purposes and results of an Order of the Arkansas Public Service Commission entered on December 10, 1957, in Docket U -1281 relating to the treatment by the Telephone Company of all City special taxes. In so recognizing, the City expects that the said net additional taxes, together with cost of collection thereof, provided for by Section 1 hereof, may be passed on to the customers of the telephone company in keeping with the provision of the said Order of the Arkansas Public Service Commission. SECTION 4. All ordinances and parts of ordinances that con- flict herewith are hereby repealed. Provided, however, Ordinance No. 11,345 is repealed only to the extent that same is in direct conflict herewith and nothing herein shall be construed to other- wise alter or change the terms or conditions of the present privilege authority under which the Telephone Company is operating. SECTION 5. It is hereby found by the Board of Directors that there is an urgent need for additional revenues for the City. Therefore, an emergency is hereby declared to exist and this ordinance being necessary for the preservation and advancement of the public peace, health and safety, shall be in full force and effect from and after date of its approval.
