ORDINANCE NO. 191148
3 AN ORDINANCE TO DISPENSE WITH THE REQUIREMENT OF
4 COMPETITIVE BIDDING AND AUTHORIZE THE CITY MANAGER TO
5 ENTER INTO A CONTRACT WITH PULASKI COUNTY, ARKANSAS, FOR
6 ALTERNATIVE SCHOOL SERVICES; AND FOR OTHER PURPOSES.

8 WHEREAS, the City of Little Rock may dispense with the requirement of
9 competitive bidding in exceptional situations where such procedure is not feasible, and
10 WHEREAS, the City finds that competitive bidding for Alternative School
11 Services is not feasible as the Pulaski County Alternative School on Roosevelt Road
12 remains the only school that offers services to students who have been expelled from
13 other schools for acts of violence.
14 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
15 OF THE CITY OF LITTLE ROCK, ARKANSAS:
16 Section 1. The Board of Directors finds that competitive bidding should be
17 dispensed with for the purpose of alternative school services for violent offenders, as an
18 exceptional situation exists and competitive bidding is impractical and infeasible.
19 Section 2. The City Manager is hereby authorized to dispense with competitive
20 bidding and to enter into a contract with Pulaski County for Alternative School Services
21 for $35,000.00 for the period beginning September •1, 2004, and ending August 31, 2005.
22 Section 3. SeverabiIity. In the event any title, section, paragraph, item, sentence,
23 clause, phrase, or word of this ordinance is declared or adjudged to be invalid or
24 unconstitutional, such declaration or adjudication shall not affect the remaining
25 portions of the ordinance which shall remain in full force and effect as if the portion so

declared or adjudged invalid or unconstitutional was not originally a part of the
ordinance.
Section 4. Repealer. All ordinances and resolutions, and parts thereof, which are
in conflict with any provision of this ordinance are hereby repealed to the extent of such
conflict.
