AN ORDINANCE VACATING AND CLOSING
JOHNSON STREET BETWEEN SIXTH AND
SEVENTH STREETS, IN FEILDS ADDITION
TO THE CITY OF LITTLE ROCK.
WHEREAS, a petition was duly filed with the Board of
Directors of the City of Little Rock, Arkansas, on the 30th
day of May, 1980, asking the Board of Directors to vacate and
abandon all of Johnson Street between Sixth and Seventh Streets,
in Block 7, Feilds Addition to the City of Little Rock, as
designated on the plat of said Addition now appearing of
record in Deed Book 1, Page 147, in the office of the Recorder
of Pulaski County, Arkansas, subject, however, to any public
easements in said street; and
WHEREAS, after due notices as required by law, the Board
of Directors has, at the time and place mentioned in the notice,
heard all persons desiring to be heard on the question and has
ascertained that the street, hereinbefore described, has
heretofore been dedicated to the public use as a street, as
herein described and is no longer needed for corporate purposes;
that all of the owners of the property abutting upon the street
to be vacated have filed with the Board of Directors their
written consent to such abandonment; and that public interest
and welfare will not be adversely affected by the abandonment
of such street; and
WHEREAS, pursuant to Ark. Stat. Ann. §19 -2304 and
§19 -3825 the City of Little Rock has the power to vacate and
abandon a street, or any portion thereof, in order to better
provide for the public welfare, safety, comfort and convenience
of the inhabitants of the City.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS.
SECTION.. The City of Little Rock, Arkansas hereby
releases, vacates and abandons all its rights, together with
ti
rights of the public generally, in and to the street designated
as follows:
Johnson Street between Sixth and Seventh
Streets
subject, however, to any public utility easements located
in said street.
SECTION 2. A copy of this Ordinance, duly certified
by the City Clerk, shall be filed in the office of the Recorder
of Pulaski County and recorded in the Deed Records of the
County.
SECTION 3. This Ordinance shall take effect and be
in force from and after its passage.
