PULASKI COUNTY CIRCUIT /COUNTY CLERK 1 ORDINANCE NO. 20,623 Fees $20.00 2 3 AN ORDINANCE TO ACKNOWLEDGE THE DISSOLUTION OF VIMY 4 RIDGE WATER IMPROVEMENT DISTRICT NO. 139 OF THE CITY OF 5 LITTLE ROCK, ARKANSAS; TO AGREE TO ACCEPT THE TRANSFER 6 OF THE DISTRICT'S BOOKS, RECORDS AND SURPLUS FUNDS; TO 7 ASSUME THE RESPONSIBILITIES, OBLIGATIONS AND LIABILITIES 8 OF THE DISTRICT; AND FOR OTHER PURPOSES. 9 10 WHEREAS, the City created the Vimy Ridge Water Improvement District No. 139 ( "the District ") 11 pursuant to Little Rock, Ark., Ordinance No. 14,699 (July 3, 1984); and, 12 WHEREAS, the District has fully retired and paid out the bonded indebtedness of the District and, 13 pursuant to a resolution adopted by the Commissioners of the District on January 16, 2012, has approved 14 the dissolution of the District and the transfer of its books, records and surplus funds to the City of Little 15 Rock, Arkansas ( "the City"); and, 16 WHEREAS, the District has returned excess collections to the property owners pro rata as set forth 17 in Ark. Code Ann. § 14 -89 -1202 (West 2004); and, 18 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 19 OF LITTLE ROCK, ARKANSAS: 20 Section 1. The City accepts the transfer from the District of the District's books, records and surplus 21 funds and in consideration of such transfer assumes the obligations, responsibilities, and liabilities of the 22 District. 23 Section 2. The Mayor and City Clerk, or their duly designated representatives, are hereby authorized 24 to execute and deliver any and all further agreements, writings, certificates, releases and such other 25 writings, and to do any and all things necessary and appropriate, upon the advice and counsel of the City 26 Attorney, to give effect to the transactions contemplated in this Ordinance. 27 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 28 word of this ordinance is declared to adjudged to be invalid or unconstitutional, such declaration or 29 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 30 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 31 ordinance. 32 Section 4. Repealer. All ordinances and resolutions, and parts thereof, which are in colpict. with 33 any provision of this ordinance are hereby repealed to the extent of such conflict.
