PULASKI COUNTY CIRCUIT /COUNTY CLERK ORDINANCE NO. 20,622 Fees $20.00 AN ORDINANCE TO AUTHORIZE THE SALE OF PROPERTY OWNED BY THE CITY OF LITTLE ROCK AT 421 PRESIDENT CLINTON AVE- NUE; TO DISPENSE WITH THE REQUIREMENT FOR COMPETITIVE BIDS TO BUILD A NEW POLICE KIOSK FOR THE RIVER MARKET AREA; TO DECLARE AN EMERGENCY; AND FOR OTHER PURPOS- ES. WHEREAS, there is a desire to develop the site at 421 President Clinton Avenue as part of construc- tion and development work for the Central Arkansas Library System and for other ventures; and, WHEREAS, Clinton- Commerce, LLC, has offered to build the City a new police kiosk across the street in exchange for title to the property upon which kiosk currently sits; and, WHEREAS, this construction will occur as a part of other construction done by Clinton- Commerce, LLC, in the area, and will cost more than the independently appraised value of the City's property; and, WHEREAS, it is more cost effective to do the design and construction as part of an overall project which, in addition to the enhanced value for the property the City will receive, makes it impractical and unfeasible to bid; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: 21 Section 1. Pursuant to Ark. Code Ann. § 14- 54- 302(c) (West Supp. 2012) this ordinance shall serve 22 23 24 25 26 27 28 29 30 31 32 33 as the written resolution to authorize the conveyance of the City's interest in property at 4521 President Clinton Avenue, also known as Part of Lot 6, Block 8 Pope's Addition to the City of Little Rock, Pulaski County, Arkansas, being more particularly described as follows: Beginning at the Northeast corner of said Lot 6, then West along the north prop- erty line of said Lot 6, 25.09 feet; thence South 30.0 feet; thence East 25.0 feet to a point on the East property line of said Lot 6; thence North along said property line 30.0 feet to the Northeast corner of Lot 6 and the point of beginning. Section 2. As value for this conveyance, the City shall receive the benefit of One Hundred and Fifty Thousand Dollars ($150,000.00) construction costs for a new police kiosk to be built across the street up- on City property between the River Market building and the Terminal Building. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 4 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adju- 5 dication shall not affect the remaining portions of the ordinance which shall remain in full force and effect 6 as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the ordi- 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 nance. Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with the provisions of this resolution, are hereby repealed to the extent of such inconsistency. Section 6. Emergency Clause. The ability to construct a new police kiosk in the River Market area, and to take advantage of an opportunity to have it substantially constructed for the City at the same time as new construction which will benefit additions to the Central Arkansas Library System Main Campus is essential to the public health, safety, and welfare; an emergency is, therefore, declared to exist and this ordinance shall be in full force and effect from and after the date of its passage.
