13552I RESOLUTION NO. 13,552 2 3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO APPLY 4 TO THE ARKANSAS DEPARTMENT OF PARKS AND TOURISM FOR A 5 STATE OUTDOOR GRANT FOR IMPROVEMENTS AT NATURAL 6 STEPS PARK; AND FOR OTHER PURPOSES. 7 8 WHEREAS, staff of the Parks and Recreation Department has worked with organized ball programs 9 to develop a plan for improvements at Natural Steps Park; and, 10 WHEREAS, the plan reflects soccer fields, pavilions, concessions building, restrooms, trails, picnic 11 areas, fishing piers and related support amenities; and, 12 WHEREAS, there is an opportunity to apply to the Arkansas Department of Parks and Tourism for a 13 State Outdoor Grant in an amount up to Two Hundred Fifty Thousand Dollars ($250,000.00); and, 14 WHEREAS, Outdoor Grants are administered by Arkansas State Parks and Touring and funding 15 comes from the Land Water Conservation Fund, which is a 50/50 match program; and, 16 WHEREAS, this governing body understands the grantee and grantor will enter into a binding 17 agreement which obligates both parties to policies and procedures contained in the Land and Water 18 Conservation Fund Grants Manual including, but not limited to the following; the park area defined by 19 the project boundary map, submitted in the application, must remain in outdoor recreation use in 20 perpetuity, regardless if the property is bought or developed with matching grant funds; and, all present 21 and future overhead utility lines within the project boundary must be routed away or placed underground; 22 and, the project area must remain open and available for use by the public at all reasonable times of the 23 day and year; facilities can be reserved for special events, league play, etc., but cannot be reserved, leased 24 or assigned for exclusive use; and, the project area must be kept clean, maintained, and operated in a safe 25 and healthful manner; and, 26 WHEREAS, if Central Arkansas Water should determine that they require the land back for their 27 purposes, then land and improvements of equal value must replace the loss; 28 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 29 OF LITTLE ROCK, ARKANSAS: 30 Section 1. The Board of Directors hereby authorizes the City Manager to submit an application to the 31 Arkansas Department of Parks and Tourism for a state outdoor grant for improvements at Natural Steps 32 Park. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the resolution which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the resolution. Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
