Stewart owned two horses, which were kille in an accident July 6, 1918, by the City fire apparatus, at the orner of Markham and Rock streets; and Whereas, his son, Will Stewart, the driver of said horses, injured; and Whereas, the City Attorney advises this Council that there s no liability for either or the killing of said horses or the njury to the person of the said Will Stewart, but the Council de- iring to compensate the said parties for their damage caused by aid accident; and Whereas, the said D. W. Stewart and Will Stewart have greed to accept the sum of Two Hundred Fifty Dollars ($250.00) in all settlement of any and all claims they may have against the ity of Little Rock, or any of its employees, arising through the eath of said horses or the injury to the said Will Stewart; Nov, herefore: E IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK: That the sum of Two Hundred Fifty Dollars (250.00) be and; ;the same is hereby appropriated out of the general fund to pay the aid D. W. Stewart and Will Stewart a portion of the value of said gorses and for the damage to the person of the said Will Stewart ;rowing out of said accident, the said fund to be paid to the said parties only upon the execution by the said parties of a full and omplete receipt and release of the City of Little Rock and all is employees from all claims which they may have against the City !or said employees, and especially for the killing of said horses d the injury to the said Will Stewart in said a ident on July 6, 918.
