10774 dip a RESOLUTIO11. /o 7 ''ihereas, under the franchise of the Little Rock Railway j & Electric Company, the said company assumed the burden of con- structing and maintaining, between its rails and two feet on each side thereof, according to the grade at that time or thereafter established, a pavement similar to the improvement or pavement made upon other parts of said street, regardless of the condition of the other portions of any of said streets along which its traej might run, and provided that should the company fail to do said work on said streets `between its tracks and two feet on each side thereof and maintain the same, the city might do said work at the expense of said company; and, ,7hereas, Idoreno- Burkham Construction Company were em- ployed by the city to repair certain portions of certain streets between the rails and tv,o feet on each side thereof and the city has repaired other portions of the streets of Tuttle Rock be- ` tween the rails and two filet on each side thereof, and there are I certain other stre=ets in the City of Little Rock Moon which the roadway between' the rails and two feet on each side thereof has not been- maintained in a reasonably good state of repair by said little Rock Railway & Electric Company; NUN, THEREFORE; BE IT RESOLVED BY THE CITY CO1MC IL OF THE CITY OF LIT TIE ROCK:- Section 1. That the cite engineer shall render to this council at its next meeting an itemized statement of the amounts due from the said little Rock Railway & Electric Company for work performed on said streets by Moreno- Burkham Constructio ,_ r Company, by the City of' little Rock and its employees, and shall also render a detailed report of the streets upon which work i I should be done by the Little Rock Railway & Electric Company to place the roadway between its tracks and two feet or, each side thereof in reasonably good condition. Section 2. That the city clerk mail to the Little Rocs Railway & Electric Company a copy of this resolution, and that the city engineer marl to the Little Rock Railway & Electric Company an exact copy of the itemized statement and an exact copy of the report called for ir_ this resolution. Section 3. That the City Council consider said itemized statement and report as special items of business to be considered in preference to other matters at its next regular imeeting. Adopted: Sept.
