"^4'REAS,- The Pulaski Heights Land Company nn March 24, 1908 filed for record in Pulaski County a plat with bill oll assurance to certain blocks in Pulaski Heights, among others bloclxs eighteen (18) and nineteen (19), on which plat is shoar. Br ^wn Street immediately ad- joining blocks eighteen (18) and nineteen (19) on the north and the said bill of assurance among other things states that if the said streets are abandoned as public streets or converted to any other purpose than that for which this dedication is made, the said street shall irrmediatsly revert back to the grantors or their assigns. And- 77FRFAS, it was found that it was impractical to or_en the said Brown Street north of the said blocks eighteen (18) and nineteen. (19) on account of the irreg,..,larity of s�arf�l+ of the ground And because of the fact that same would be located in a very Seep ravine which mode its location almost impossible, and the said street never had been open and the said Pulas'.si Heights Land Company on December 2Qth, 1916 caused to be executed another plot And b'11 of assurance correcting the former plat reciting that it having been found that errors occurred in the orig- inal survey in establishing the corners of the said blocks as filed in the original plat and as the property rights had nest become vested And mould not become disturbed by the present corrected survey, therefore it attached a new plat resublividing the said property and showing nc street north of the said bl"ks eighteen (18) and nineteen (19), clearly showing that it was the intention that no such street be opened north of the said blocks `eighteen (18) and nineteen (19) extending -ast from what was then called Elm Street and l ?ter called Beech Street, being the street leading from Prostect Avenue out onto Hillarest. TEPPEFORE, BE IT FFSOLVF'D TAAT in view of the fact that it is found that the opening of the said street north of bloc'Js eighteen. (18) Y and nineteen (19) Pulaski Heights is impractical and the said Pulaski Heights Land Company replatted the sail property vacating the sail street and in view of the fact that no such str -et has ever been opened or used, the City of Little Roclt here' -y disclaims any interest in and to the sail street located as above described sn1 farther declares that the same is hereby declared to be ab9ndoned and vacated.
