That the zoning classification of the following described property be changed from PCD to Revised PCD: Tract 1 - Part of the NE' /4 of the NW '/4 Section 23, T -1 -N, R -13 -W, Pulaski County, Arkansas described as: commencing at the intersection of the centerline of Barrow Road and the centerline of Arkansas State Highway 5; thence Northerly along the centerline of Barrow Road 30 feet, more or less, to a point in the north right -of -way line of Highway 5,; thence in an easterly direction along the north right -of -way line thirty (30) feet to the point of beginning, from the point of beginning run easterly along the north right -of -way line of Highway 5, 125.0 feet; thence northerly parallel to Barrow 125.0 feet; thence westerly perpendicular to Barrow Road, 125.0 feet more or less, to the east right -of -way to the point of beginning containing 0.36 acres, more or less. That the approval of Akel Revised Short-Form PCD (Z- 8236 -A), located at 8724 Colonel 7 Glenn Road, is subject to compliance with the following additional conditions: 8 That the preliminary site development plan/plat be approved as submitted, 9 including all staff comments and conditions as outlined in the Planning Commission 10 Agenda Staff Report in paragraphs D, E, F and including any conditions indicated in 11 the staff analysis in paragraph H and subject to additional conditions imposed at the 12 Planning Commission Public Hearing as amended by the applicant. 13 Section 3. That the preliminary site development plan/plat be approved as recommended by the 14 Little Rock Planning Commission. 15 Section 4. That the change in zoning classification contemplated for Akel Revised Short-Form PCD 16 (Z- 8236 -A), located at 8724 Colonel Glenn Road, is conditioned upon obtaining a final plan approval 17 within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances. 18 Section 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little 19 Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects 20 necessary to affect and designate the change provided for in Section I hereof. 21 Section 6. That this ordinance shall not take effect and be in full force until the final approval of the 22 plan. 23 Section 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 24 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 25 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 26 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 27 ordinance. 28 Section 8. Repealer.
