1288RESOLUTION NO. _\'� ',-;HEREAS, There is now pending in the Chancery Court of ­ulaski County, ,rkansas, a certain cause, numbered 456629 wherein the City of Little Rock is plaintiff, and ',J'.E.Lenon., as executor of the estate of Jean H. Coffman, deceased, together with the various beneficiaries under the will of said Jean H. Coffman, deceased, are defendants: and "'T -i -" said cause and a subse- quent upon- appeal thereof to the Supreme Court of -irkansas, it was adjudged that the City of Little 7,ock should recover from said defendants, for the use and benefit of the City 'Hospital, all property belonginf to the estate of G.T.Coffman, deceased, and remaining undisposed of by Jean H. Coffman during her lifetime; and said cause vias remanded to the Chancery Court with directions to ascertain the nature and value of such property, and has since been pending for a trial of such issue; and -THEREAS) the parties to said litigation hate agreed up ,on a tentative compromise thereof, by the terms of which W.E. Lenon, as executor of the estate of Jean 14. Coffman, deceased, shall pay to the City of Little Rock, for the use and benefit of the Cit r Hospital, the sum of 115,000.00 cash., in consideration whereof a consent decree shall be entered in said cause, divesting out of the City of Little Rock all of its right, title, claim and interest in and to all property, real and personal, belonging to the estate of C.T.Coffmanj deceased, and disposed of by the terms of his will and codicil, and whereby the title of defendants to all such property shall be quieted and confirmdd as against the City of Li. the Rock; NO71 THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF T1-17, CITY OF LITTLE ROCK: section 1. The Cit.- attorney is hereby authorized and directed to consummate said offer of compromise by accenting on -1- behalf of the City of Little Rock, for the use and benefit of the City Hospital., the sum of ;`'15,000.00 cash to be paid by '.7.E.Lenon, as Executor of the estate of Jean H. Coffman, deceased, in full settlement and satisfaction of the above mentioned cause of action, and of all right, title, interest and claim of the City in and to all property, real and personal, belonging to the Estate of C'.TL.Coffman deceased, and disposed of by the terms of his will and codicil. Section 2. In order to carry said compromise agreement into effect, the City Attorney is further authorized and directed to enter into a consent decree in said cause, whereby said suit shall be settled and compromised upon the terms and provisions herein speci,fied.
