RESOLUTION NO. 13,524
A RESOLUTION TO RECOMMEND AN AMENDMENT TO ARK. CODE
ANN. § 21 -8 -708 TO REQUIRE THE MEMBERS OF ALL STATUTORY
ENTITIES WITH THE POWER OF EMINENT DOMAIN TO FILE
STATEMENTS OF FINANCIAL INTEREST; AND FOR OTHER
PURPOSES.
WHEREAS, certain public officers and employees are required to file a statement of financial
interest pursuant to Ark. Code Ann. § 21 -8 -708, as amended; and,
WHEREAS, certain statutorily created entities are granted the power of eminent domain; and,
WHEREAS, it is important that such a power be exercised by public servants who are subject to the
state ethics codes;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
OF LITTLE ROCK, ARKANSAS:
Section 1. The Board of Directors endorses the passage of legislation to require the member of any
statutorily created entity that is granted the power to eminent domain to be required to file a statement of
financial interest in accordance with Ark. Code Ann. § 21 -8 -708, as amended, and directs the Mayor and
City Manager to work with the Arkansas Municipal League to have such proposed legislation introduced
during the 2013 session of the Arkansas General Assembly.
Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
resolution.
26 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent
27 with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
