Code Ann. § 11 14 -54 -104; and 12 WHEREAS, the Board has determined that this easement lies entirely within the applicants' property 13 and that the abandoning of this easement will not have an adverse impact on the adjacent property 14 owners; 15 WHEREAS, there are no utility facilities either existing or planned to be located in the easement and 16 all reviewing agencies have approved the abandonment; 17 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 18 OF LITTLE ROCK, ARKANSAS: 19 Section 1. The Board of Directors hereby releases, vacates, and abandons the North 164 feet of 20 the ten (10) -foot wide easement located along the east (rear) perimeter of Lot 2, Block 21, Pleasant Valley 21 Addition to the City of Little Rock, Pulaski County, Arkansas. 22 23 24 25 26 27 28 29 30 31 32 33 34 35 Section 2. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate records of the recorder of the Circuit Clerk in ex- officio recorder of Pulaski County, Arkansas. Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part of the ordinance. Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
