13462I RESOLUTION NO. 13,462 2 3 A RESOLUTION TO ESTABLISH THE 2013 LEGISLATIVE AGENDA 4 OF THE CITY OF LITTLE ROCK, ARKANSAS, BEFORE THE 89TH 5 ARKANSAS GENERAL ASSEMBLY; AND FOR OTHER PURPOSES. 6 7 WHEREAS, the Board of Directors wishes to address certain legislative issues to participate with the 8 Arkansas Municipal League in the presentation of these issues to the upcoming session of the Arkansas 9 General Assembly; and, to WHEREAS, the following matters have been reviewed internally and determined to be a part of the 11 items the City wishes to pursue in 2013; 12 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 13 OF LITTLE ROCK, ARKANSAS: 14 Section 1. The City wishes to pursue, and if appropriate to cooperate with the Arkansas Municipal 15 League in doing so, an Act: 16 (a) to allow municipalities to remove abandoned and inoperable vehicles from private property 17 in appropriate situations pursuant to an amendment to Ark. Code Ann. § 14 -54 -901 (West 18 2004) as may be amended; and, 19 (b) to provide for the appropriation of state funds for a housing trust fund administered by the 20 Arkansas Development Finance Authority to serve as a funding source for local governments, 21 and other entities, to help provide affordable housing; and, 22 (c) to amend State law to define restrictions on the purchase of scrap metal items, to require 23 scrap metal dealers to record transactions, and to enhance penalties for those entities that do 24 not comply; and, 25 (d) to provide a sliding scale for the administrative fees charged by the Arkansas Department of 26 Finance & Administration to college and distribute local Sales and Compensating Use Taxes; 27 and, 28 (e) to allow certain City and County employees to obtain information about local Sales and 29 Compensating Use Tax collection and distribution. 30 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 31 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 32 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and [Page 1 of 21 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the resolution. Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
