13437I RESOLUTION NO. 13,437 2 3 A RESOLUTION TO AMEND LITTLE ROCK, ARK. RESOLUTION NO. 4 13,417 (JANUARY 3, 2012) TO AUTHORIZE THE PROVISION FOR AN 5 OPTION TO RENEW THE ANNUAL PURCHASE CONTRACT WITH 6 MID -SOUTH SALES EACH YEAR FOR UP TO TWO (2) ADDITIONAL 7 YEARS UPON AGREEMENT OF THE PARTIES; AND FOR OTHER 8 PURPOSES. 9 10 WHEREAS, on January 3, 2012, the Board of Directors adopted Little Rock, Ark., Resolution No. 11 13,417 to authorize the City Manager to enter into an annual purchase contract with Mid -South Sales for 12 the purchase of oils and lubricants for the City's fleet, with the annual purchase contract not to exceed 13 One Hundred Thousand Dollars ($100,000.00); 14 WHEREAS, the parties wish to amend Resolution 13,417 to provide the option to renew the annual 15 purchase contract each year for up to two (2) additional years upon the agreement of the City and Mid - 16 South Sales; 17 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 18 OF LITTLE ROCK, ARKANSAS: 19 Section 1. The Board of Directors hereby amends Little Rock, Ark., Resolution No. 13,417 (January 20 3, 2012) to authorize provision for the option to renew the annual contract each year for up to two (2) 21 additional years upon the agreement of the City and Mid -South Sales. 22 Section 2. Funds for this purpose are allocated in the 2012 Parts Budget. 23 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 24 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 25 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 26 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 27 resolution. 28 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, particularly Little Rock, 29 Ark., Resolution No. 13,417 (January 3, 2012), that are inconsistent with the provisions of this resolution, 30 31 32 33 34 35 are hereby repealed to the extent of such inconsistency.
