RESOLUTION NO. 13,420
3 A RESOLUTION TO APPOINT REPLACEMENT COMMISSIONERS FOR
4 MUNICIPAL IMPROVEMENT DISTRICT NO. 21 OF LITTLE ROCK,
5 ARKANSAS - UNIVERSITY HEIGHTS PROJECT, AND FOR OTHER
6 PURPOSES.
7 WHEREAS, Adam Richey, James E. Strode and Chuck Keller, the three (3) commissioners of
8 Municipal Improvement District No. 21 of Little Rock, Arkansas — University Heights Project ( "District "),
9 resigned effective September 15, 2011, and
10 WHEREAS, if all places on a Municipal Improvement Board shall become vacant, State Law at Ark.
11 Code Ann. § 14- 88- 303(b) (West Supp. 2011) provides that new members shall be appointed by the
12 municipality's governing body, and
13 WHEREAS, the new fee owner of the Mid -Towne Little Rock Shopping Center, IMI MTLR LLC,
14 has requested that the City Board of Directors appoint Andrew Miller, John Neutzling and Richard Kobe as
15 replacement commissioners on the District's Board of Commissioners.
16 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
17 OF LITTLE ROCK, ARKANSAS:
18 Section 1. Andrew Miller, John Neutzling and Richard Kobe are hereby appointed as members of the
19 Board of Commissioners of the Municipal Improvement District No. 21 of Little Rock, Arkansas — University
20 Heights Project.
21 Section 2. This resolution shall become effective upon its adoption and approval.
22 Section 3. Severability. In the event any portion of this resolution is declared or adjudged to be
23 invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of this
24 resolution, which shall remain in full force and effect as if the portion so declared or adjudged invalid or
25 unconstitutional were not originally a part of this resolution.
26 Section 4. Repealer. All ordinances and resolutions, and parts thereof, that are in conflict with any
27 provision of this resolution are hereby repealed to the extent of such conflict.
