That the zoning classification of the following described property be changed from R -3, 13 Single - Family, to PD -O: 14 Part of the SE 1/4, SE '/4, Section 14, T -1 -N, R -13 -W, more particularly described as 15 follows: beginning at a point in the south right of way line for West 40th Street, 16 which is 20 feet south of and 54.6 feet west of the northeast corner of said SE t/4 SE 17 t /4, thence south 150 feet, thence west 160 feet, more or less to an Old Fence Line as 18 shown on plat C.B. Pendergraft, on April 5, 1950, thence north along said fence line 19 150 feet to the south right of way line of West 40th Street, thence east along said 20 south right of way line of West 40th Street 160 feet more or less to the point of 21 beginning, in Pulaski County, Arkansas. 22 23 Property Description of Parcel 2; Part of the SE t /4, SE t /4, Section 14, T -1 -N, R -13- 24 W, more particularly described as follows; beginning at a point of the south line of a 25 County Road, also known as West 40th Street which in 212 feet west and 20 feet 26 south of the northeast corner of said SE '/4, SE '/4 Section 14, thence run south along 27 and old fence line a distance of 200 feet thence run west 80.5 feet, thence run north 28 200 feet to the south line of West 40th Street and thence run east 80.5 feet to the 29 point of beginning. 30 Section 2. That the approval of Delta Presents Outreach Foundation Short -Form PD -O, located at 31 7621 West 401h Street (Z- 8696), is subject to compliance with the following additional conditions: 32 That the preliminary site development plan/plat be approved as submitted, including all 33 staff comments and conditions as outlined in the Planning Commission Agenda Staff [PAGE 1 OF 21 • 1 Report in paragraphs D, E, F and including any conditions indicated in the staff analysis 2 in paragraph H and subject to additional conditions imposed at the Planning Commission 3 Public Hearing as amended by the applicant. 4 Section 3. Section 4. That the change in zoning classification contemplated for Delta Presents Outreach Foundation Short -Form PD -O, located at 7621 West 40`h Street (Z- 8696), is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances. Section 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof. Section 6. That this ordinance shall not take effect and be in full force until the final approval of the plan. Section 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the ordinance. Section 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
