133951 Fa RESOLUTION NO. 13,395 3 A RESOLUTION TO AMEND LITTLE ROCK, ARK., RESOLUTION NO. 4 13,376 (OCTOBER 3, 2011) TO AUTHORIZE THE CITY MANAGER TO 5 ENTER INTO CONTRACTS FOR THE CONSTRUCTION AND 6 REHABILITATION OF TWO (2) SINGLE - FAMILY DWELLINGS AS 7 PART OF THE NEIGHBORHOOD STABILIZATION PROGRAM 2 8 (NSP2); TO CORRECT AN ERROR IN REGARD TO THE TWO (2) 9 COMPANIES TO RECEIVE THE CONTRACTS; AND FOR OTHER 10 PURPOSES. 11 12 WHEREAS, the Board of Directors adopted Little Rock, Ark., Resolution No. 13,376 on October 3, 13 2011, for the purpose of approving the use of NSP2 funds for the construction and rehabilitation of two 14 (2) residential structures located at 1800 Brown Street and 2609 West 13th Street, and 15 WHEREAS, the City Manager was authorized to enter into contracts with DBI Construction to 16 complete the construction and rehabilitation projects on the two (2) structures, and 17 WHEREAS, DBI Construction should only have been awarded the contract for the structure located 18 at 1800 Brown Street, and 19 WHEREAS, Ford Properties Homes was the lowest responsive and responsible bidder to construct 20 and rehabilitate the structure located at 2609 West 13th Street, and 21 WHEREAS, it is necessary to amend Resolution No. 13,376 in order to authorize the City Manager 22 to enter into separate contracts for the two (2) structures. 23 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 24 OF LITTLE ROCK, ARKANSAS: 25 Section 1. The Board of Directors hereby reiterates its approval of the use of NSP2 Funds in the 26 amount of Two Hundred Sixteen Thousand, Four Hundred Thirty-Two Dollars ($216,432) for the 27 construction and rehabilitation of two (2) residential structures located at 1800 Brown Street and 2609 28 West 13th Street. However, due to an error contained in Resolution No. 13,376, it is necessary to amend 29 the resolution to accurately reflect that two separate companies should have been awarded contracts for 30 the two (2) structures. 31 Section 2. The Board hereby amends Resolution No. 13,376 as follows. The City Manager is 32 authorized to enter into a contract with DBI Construction in the amount of Eighty-Seven Thousand, Five 33 Hundred Dollars ($87,500) for the structure located at 1800 Brown Street, and with Ford Properties PAGE 1 OF 21 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 Homes in the amount of One Hundred Twenty -Eight Thousand, Nine Hundred Thirty-Two Dollars ($128,932) for the structure located at 2609 West 13th Street. Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the resolution which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the resolution. Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
