13394I RESOLUTION NO. 13,394 2 3 A RESOLUTION TO AMEND LITTLE ROCK, ARK., RESOLUTION NO. 4 13,384 (OCTOBER 18, 2011) TO AUTHORIZE THE CITY MANAGER TO 5 ENTER INTO A CONTRACT EXTENSION WITH WASTE 6 MANAGEMENT OF ARKANSAS TO PROVIDE FOR CURBSIDE 7 RECYCLING FOR SOLID WASTE CUSTOMERS UNDER AN 8 AGREEMENT WITH PULASKI COUNTY REGIONAL SOLID WASTE 9 MANAGEMENT DISTRICT; AND FOR OTHER PURPOSES. 10 11 WHEREAS, the City of Little Rock entered into an agreement with the Pulaski County Regional 12 Solid Waste Management District (PSRWMD) beginning on May 6, 2003, for a period of seven (7) years, 13 to contract with Waste Management of Arkansas to provide curbside recycling for all solid waste 14 customers, and 15 WHEREAS, the parties mutually extended the contract to maintain service through September 30, 16 2011, and 17 WHEREAS, on October 18, 2011, the Board of Directors adopted Little Rock, Ark., Resolution No. 18 13,384 (October 18, 2011) to authorize the City Manager to enter into an extension of the existing 19 curbside recycling contract through February 28, 2012, with Waste Management of Arkansas to provide 20 curbside recycling for approximately 58,000 solid waste customers, at a cost of $2.20 per month per 21 residential customer, and 22 WHEREAS, the parties now wish to amend Resolution No. 13,384 to change the curbside recycling 23 extension date to March 31, 2012, in order to acquire equipment and make process changes to begin 24 single- stream recycling process on April 2, 2012; 25 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 26 OF LITTLE ROCK, ARKANSAS: 27 Section 1. The Board of Directors hereby amends Little Rock, Ark., Resolution No. 13,384 (October 28 18, 2011) and authorizes the City Manager to enter into an extension of the existing curbside recycling 29 contract through March 31, 2012, with Waste Management of Arkansas to provide curbside recycling for 30 approximately 58,000 solid waste customers, at a cost of $2.20 per month per residential customer. 31 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the resolution which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the resolution. Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, particularly Little Rock, Ark., Resolution No. 13,384 (October 18, 2011), that are inconsistent with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
