20482:►'�,c`'�^C —�R�� v 2011059424 Received: 10/7/2011 9:20:55 AM Recorded: 10/07/2011 09:25:08 AM Filed & G� Recorded in Official Records of Larry Crane, PULASKI COUNTY CIRCUIT /COUNTY CLERK 1; ,E ORDINANCE NO. 20,$2 $20.00 ''2 Y =� S f _ AN ORDINANCE TO ESTABLISH A THREE (3) -YEAR STATUTE OF 4 LIMITATIONS FOR THE VIOLATION OF ANY CITY ORDINANCE; TO 5 REPEAL ANY OTHER STATUTE OF LIMITATIONS WHICH MAY AP- 6 PEAR IN THE CITY CODE OF ORDINANCES; TO DECLARE AN 7 EMERGENCY; AND, FOR OTHER PURPOSES. 8 9 WHEREAS, the 88`h General Assembly passed a bill, which the Governor signed into law, that per - 10 mits a local government to set up to a three (3) -year statute of limitations for the violation of a City ordi- 11 nance; and, 12 WHEREAS, that statute is now in effect; and, 13 WHEREAS, it is the desire of the Board of Directors to be able to enforce City ordinance violations 14 for a period of three (3) years; 15 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 16 OF LITTLE ROCK, ARKANSAS: 17 Section 1. The Little Rock, Ark., Code of Ordinances (1988) is hereby amended to add the fol- 18 lowing section: 19 The statute of limitations for any City ordinance violation shall be three (3) 20 years from the date of the violation. 21 Section 2. Severability. In the event any section, subsection, subdivision, paragraph, subparagraph, 22 item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconsti- 23 tutional, such declaration or adjudication shall not affect the remaining provisions of this ordinance, as if 24 such invalid or unconstitutional provision were not originally a part of this ordinance. 25 Section 3. Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent with this or- 26 dinance are hereby repealed to the extent of such inconsistency, and any ordinance that sets a statute of 27 limitations other than the three (3) -year period set forth in this ordinance is hereby expressly repealed. 28 Section 4. Emergency Clause. The ability to properly enforce ordinance violations is essential to 29 the public health, safety and welfare, and should not be thwarted by the current one year statute of limita- 30 tions; the General Assembly has recognized this fact, and the Governor has signed into law Act 698 of 31 2011, which requires affirmative action by the local governing body to extend a statute of limitations for 32 ordinance violations as this ordinance does; an emergency is, therefore, declared to exist and this ordi- 33 nance shall be in full force and effect from and after the date of its passage and publication.
