13373I 2 RESOLUTION NO. 13,373 3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO 4 APPROVE A ONE (1) -YEAR EXTENSION OF THE ANNUAL 5 MAINTENANCE AGREEMENT WITH MOTOROLA, INC.; AND FOR 7 8 WHEREAS, Motorola, Inc., has provided the maintenance for the City's 800 MHz radio system 9 infrastructure for over seventeen (17) years; and 10 WHEREAS, Grace Communications Company of North Little Rock is the only communications 11 company in central Arkansas which has Motorola trained technicians, the proprietary software and testing 12 equipment available to maintain the City's radio network infrastructure and is the service provider 13 authorized by Motorola; and 14 WHEREAS, Little Rock, Ark., Ordinance No. 20,158 (September 15, 2009) dispensed with 15 competitive bidding and awarded a maintenance agreement with Motorola, Inc., for the City's emergency 16 communications infrastructure, including the portable and mobile radios utilized by the Little Rock Police 17 Department; and 18 WHEREAS, the ordinance also provided for three annual extensions of the agreement with Motorola 19 Inc. upon recommendation of the City Manager. 20 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 21 OF LITTLE ROCK, ARKANSAS: 22 Section 1. The Board of Directors hereby authorizes the City Manager to enter into a one (1) -year 23 extension of the agreement with Motorola, Inc., in the amount of Six Hundred Forty-Eight Thousand, 24 Five Hundred Seven and 51 /100 Dollars ($648,507.51), for Grace Communications of North Little Rock 25 to provide maintenance service for the City's MHz radio system. 26 Section 2. Funding for this project is available through 9 -1 -1 fees. 27 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 28 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 29 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 30 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 31 resolution. 32 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent 33 with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
