3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER INTO
4 AN AGREEMENT WITH THE ARKANSAS HIGHWAY AND
5 TRANSPORTATION DEPARTMENT FOR THE INTERSTATE
6 430/INTERSTATE 630 INTERCHANGE MODIFICATIONS (PHASE III)(F);
7 AND FOR OTHER PURPOSES.

9 WHEREAS, the Arkansas Highway and Transportation Department (AHTD) has awarded a bid for
10 the Interstate 430 /Interstate 630 Interchange Modifications (Phase 111)(F) project in the amount of
11 $78,123,925.30; and
12 WHEREAS, the City of Little Rock is responsible for project costs located within the City's right -of-
13 way; and
14 WHEREAS, the City's total project cost within the City's right -of -way, including the estimated cost
15 of right -of -way, utility adjustments and construction engineering, is $2,134,655.92; and
16 WHEREAS, the amount of Federal -aid earmarks available to the City of this project is
17 $1,033,691.00; and
18 WHEREAS, the City's remaining balance of project cost is $1,100,964.92;
19 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
20 CITY OF LITTLE ROCK, ARKANSAS:
21 Section 1. The City Manager or his designee is hereby authorized and directed to execute all
22 appropriate agreements and contracts necessary to expedite the award of the contract for this project to
23 Weaver - Bailey Contractors, Inc., of El Paso & Manhattan Road & Bridge Company of Tulsa, Oklahoma,
24 a joint venture.
25 Section 2. The City of Little Rock, Arkansas, pledges its full support and hereby authorizes the
26 Arkansas State Highway and Transportation Department to initiate action to implement this project.
27 Section 3. The amount of $1,100,964.92 is authorized to be paid to the Arkansas State Highway
28 and Transportation Department. Funding will be provided from the remaining 1995 Capital
29 Improvements Fund $19,781.05, the remaining 2004 Capital Improvements Fund Project B00ISRI
30 $208,549.69, the Developer In -Lieu Special Project S000178 $315,806.70, and from the City's Street
31 Funds Account $556,827.48 as local matching funds for this project.
32 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase,
33 or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
34 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and

effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
resolution.
Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent
with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
