SMITH TO THEIR 5 SUCCESSOR FIBERGLASS SYSTEMS, LP, AS REQUIRED BY A LEASE 6 BETWEEN THE PARTIES PURSUANT TO A 1963 ACT 9 BOND ISSUE WITH 7 PREDECESSOR A.O. SMITH; AND FOR OTHER PURPOSES. 8 9 WHEREAS, the City issued Act 9 bonds in 1963 to finance the construction of an industrial facility 10 for the A.O. Smith company, which has operated continuously at 2700 West 65th Street; and 11 WHEREAS, the successor Company is named Fiberglass Systems, LP; and 12 WHEREAS, Section 1902 (D) of the lease between the City and A.O. Smith states that after the 13 bonds are paid off that the Company has the right to buy the property for $1.00 and the City shall issue a 14 Warranty Deed; and 15 WHEREAS, Fiberglass Systems, LP seeks to purchase the property for $1.00. 16 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 17 OF LITTLE ROCK, ARKANSAS: 18 Section 1. The Mayor is authorized to sign a Warranty Deed to convey the property located at 19 2700 West 65t1' Street to Fiberglass Systems, LP, pursuant to the original lease provision. 20 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 21 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adju- 22 dication shall not affect the remaining portions of the resolution which shall remain in full force and ef- 23 fect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 24 resolution. 25 Section 3. Repealer.
