13185I RESOLUTION NO. 13,185 2 3 A RESOLUTION TO RESCIND THE LITTLE ROCK PLANNING 4 COMMISSION'S ACTION IN DENYING A SPECIAL USE PERMIT 5 TO ALLOW A PAROLEE HOUSING FACILITY ON THE C -3 ZONED 6 PROPERTY LOCATED AT 10905 WEST MARKHAM STREET (Z- 7744 -A); 7 AND FOR OTHER PURPOSES. 8 9 WHEREAS, an application was filed by Randal B. Frazier/Under Grace Ministries with the Little 10 Rock Planning Commission for a special use permit to allow for a parolee housing facility on the C -3 11 zoned property located at 10905 West Markham Street; and 12 WHEREAS, the Little Rock Planning Commission, at its June 3, 2010, meeting, denied the Special 13 Use Permit application with a vote of 1 aye, 8 nays, 1 absent and 1 abstention; and 14 WHEREAS, the Little Rock Board of Directors has determined that action to be inappropriate. 15 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 16 OF LITTLE ROCK, ARKANSAS. 17 Section 1. The action of the Little Rock Planning Commission in denying a special use permit to 18 allow a parolee housing facility on the C -3 zoned property located at 10905 West Markham Street is 19 hereby rescinded. 20 Section 2. Said Special Use Permit is hereby approved, subject to Under Grace Ministries fulfilling 21 the following conditions: 22 1. Is licensed by the Department of Community Corrections (DCC). 23 2. Operates in compliance with all laws, rules and regulations of DCC. 24 3. Accepts only non - violent, non - sexual offenders; 25 4. Will have 3 employees and will maintain the number of employees required by DCC. 26 5. Has mandatory drug and alcohol testing. Zero tolerance. A failed test will result in 27 expulsion from the program and referral back to DCC. 28 6. Each resident will be required to be actively engaged in a recovery program. 29 Examples of such programs include AA and Celebrate Recovery. 30 7. Life skills will be available to the residents as well as Men's Fraternity and Woman 31 on a Mission. 32 8. A neighborhood advisory board will be created with its #1 priority being public 33 safety. It will be modeled after the City of Faith residential center and will provide 34 neighbors with current information about Hidden Creek's operations including [PAGE 1 OF 2] I population, events, and issues that may be of concern to the community. The 2 advisory board will include the Hidden Creek Director, a Little Rock City Board 3 Director, local neighbor business owners, a DCC representative, an Under Grace 4 Ministries board member, and a representative of the Little Rock Police Department. 5 Section 3.
