4 A RESOLUTION TO ACCEPT TITLE TO PR6i'LRiir;S DONATED TO THE
5 CITY OF LITTLE ROCK BY QUITCLAIM DEED, TO BE USED FOR
6 NEIGHBORHOOD REVITALIZATION PROGRAMS; AND FOR OTHER
7 PURPOSES.

9 WHEREAS, the Board of Directors has stated as one of its goals a desire to provide for
10 neighborhood revitalization, and has taken special efforts to accomplish this goal through its use of
11 various City and federal funds, and in affirmative actions such as the creation of a Land Bank
12 Commission; and,
13 WHEREAS, in order to accomplish this goal is it required that properties be obtained by the City in
14 areas that are appropriate for revitalization; and,
15 WHEREAS, Mr. and Mrs. David Featherstone have indicated their desire to donate to the City of
16 Little Rock two (2) properties located at 1911 and 1921 Cedar Street; and,
17 WHEREAS, the City wishes to accept the property for use in its neighborhood revitalization efforts;
18 and,
19 WHEREAS, the City has conducted a full title search on each property which revealed valid title to
20 the properties and no significant title issues; and,
21 WHEREAS, the City has performed an environmental assessment of each property pursuant to 24
22 C.F.R. § 58, et seq. (2003), which revealed no environmental problems; and,
23 WHEREAS, in consideration for the donation of the property for the public purpose of
24 neighborhood revitalization, the City has agreed to pay the 2009 real estate taxes for each property in the
25 amounts of $56.40 and $121.70.
26 WHEREAS, funds to pay the delinquent taxes are available in Land Bank Account No. 210359
27 63390 S35B442; and,
28 WHEREAS, Mr. and Mrs. David Featherstone have provided the City with a Quitclaim Deed to the
29 property, a copy of which is attached as Exhibit A; and,
30 WHEREAS, state law requires that the City accept the property by resolution adopted by the Board
31 of Directors;
32 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
33 OF LITTLE ROCK, ARKANSAS:

I Section 1. The Board of Directors hereby accepts the quitclaim deed to the property described in
2 Exhibit A in favor of the City of Little Rock.
3 Section 2. The property shall be used for a public purpose, specifically for City revitalization
4 programs.
5 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause,
6 phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such
7 declaration or adjudication shall not affect the remaining portions of the resolution which shall
8 remain in full force and effect a if the portion so declared or adjudged invalid or unconstitutional
9 were not originally a part of the ordinance.
10 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same that are
11 inconsistent with the provisions of this resolution are hereby repealed to the extent of such
12 inconsistency.
