3 A RESOLUTION TO GRANT THE AUTHORITY TO SUBMIT BIDS TO
4 PURCHASE PROPERTIES AT THE ARKANSAS STATE LAND COM-
5 MISSIONER'S 2010 AUCTION, TO BE USED FOR NEIGHBORHOOD
6 REVITALIZATION PROGRAMS; AND FOR OTHER PURPOSES.

8 WHEREAS, the Board of Directors has stated as one of its goals a desire to provide for
9 neighborhood revitalization, and has taken special efforts to accomplish this goal through its use
10 of various City and federal funds, and through affirmative actions, such as, the creation of the
11 Land Bank Commission; and,
12 WHEREAS, in order to accomplish this goal it is required that properties be obtained by the
13 City in areas that are appropriate for revitalization; and,
14 WHEREAS, the Land Bank Commission has chosen a focus area which encompasses the
15 area of I -630 as the northern boundary, Pine Street as the western boundary, 18th Street as the
16 southern boundary, and Martin Luther King Drive as the eastern boundary;
17 WHEREAS, the Land Bank Commission has identified twenty -five (25) properties within its
18 focus area which can be used to fulfill the City's stated goals; and,
19 WHEREAS, the City also has available to it NSP2 funds that can be used to purchase prop -
20 erties to be rehabilitated; and,
21 WHEREAS, pursuant to state law the City must obtain authority to submit bids to purchase
22 property from the Arkansas State Land Commissioner by a resolution adopted by the Board of
23 Directors;
24 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
25 THE CITY OF LITTLE ROCK, ARKANSAS:
26 Section 1. Pursuant to Ark. Code Ann. § 14- 54- 302(c) (West Supp. 2010), the City must ob-
27 tain authority from the Board of Directors to submit bids to purchase up to fifty (50) properties
28 from the Arkansas State Land Commissioner, not to exceed the sum of Seventy -Five Thousand
29 Dollars ($75,000.00), in monies available to the City other than NSP2 monies, and further, the
30 City desires to purchase up to Seventy -Five Thousand Dollars ($75,000.00) worth of properties
31 with NSP2 funds that are available to it.

Section 2. If the bids are accepted, the Board of Directors, pursuant to Ark. Code Ann. § 14-
54-302(2) (West Supp. 2010), must authorize the Mayor and City Clerk to execute any docu-
ments necessary to complete the purchase of the properties.
Section 3. If acquired, these properties shall be used for a public purpose, specifically for
City neighborhood revitalization programs.
Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause,
phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such
declaration or adjudication shall not affect the remaining portions of the resolution which shall
remain in full force and effect a if the portion so declared or adjudged invalid or unconstitutional
were not originally a part of the ordinance.
Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsis-
tent with the provisions of this resolution are hereby repealed to the extent of such inconsistency.
