3 A RESOLUTION TO AWARD A CONTRACT TO MCCORMICK
4 PAINTING COMPANY FOR PAINTING SERVICES FOR THE JIM
5 DAILEY FITNESS AND AQUATIC CENTER IN AN AMOUNT NOT TO
6 EXCEED 562,000; TO AUTHORIZE THE CITY MANAGER TO ENTER
7 INTO A CONTRACT WITH MCCORMICK PAINTING COMPANY FOR
8 SUCH SERVICES; AND FOR OTHER PURPOSES.

10 WHEREAS, Little Rock Parks and Recreation determined that a need exists for exterior
11 painting of the Jim Dailey Fitness and Aquatic Center to preserve the structure and improve its
12 appearance, and
13 WHEREAS, painting of the exterior structure will avoid larger repair costs if the painting is
14 postponed, and
15 WHEREAS, the City competitively bid the painting services through Bid No. 9242R, issued
16 on September 2, 2009, and of the two bids received, McCormick Painting Company was the
17 lowest responsive and responsible bidder.
18 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
19 THE CITY OF LITTLE ROCK, ARKANSAS:
20 Section 1. The Board of Directors hereby awards a contract to McCormick Painting Com-
21 pany to provide painting services in an amount not to exceed Sixty -Two Thousand Dollars
22 ($62,000), which includes an amount for contingencies, and authorizes the City Manager to enter
23 into a contract, in a form acceptable to the City Attorney, for such services; provided, the con -
24 tract is to be signed within thirty (30) days.
25 Section 2. The funds for the contract are enterprise funds from account 610100 - 61010.
26 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause,
27 phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such
28 declaration or adjudication shall not affect the remaining portions of the resolution, which shall
29 remain in full force and effect as if the portion so declared or adjudged invalid or unconstitu-
30 tional were not originally a part of the resolution.
