130962010012489 Received: 31812010 9:41:17 AM Recorded: 0310$!2010 09:52:03 ,4M Filed & Recorded its Official Records of PAT O'BRlEN, PULASKI COUNTY CIRCUIT/COUNTY CLERK Fees $20.00 1 RESOLUTION NO. 13,096,, 2 ,. . 3 A RESOLUTION TO DECLARE A SIX -MONTH MORATORIUM ON 4 THE APPROVAL OF APPLICATIONS FOR A SPECIAL EVENTS s CENTER WHILE THE CITY DEFINES SUCH USES AS A PART OF 6 THE ZONING ORDINANCES; AND FOR OTHER PURPOSES. s WHEREAS, the City does not have a discrete designation of "special events center," within 9 the Little Rock Code of Ordinances, and currently permits such use as a C -3 Commercial appli- 10 cation; and, 11 WHEREAS, there have been law enforcement and fire code problems with the entities that 12 now operate as a special events center; and, 13 WHEREAS, it is important to develop a detailed definition of a special events center, deter- 14 mine the parameters of such use and the specifications for such use; and, 15 WHEREAS, the City has experienced problems with crime and victimization, and has also 16 experienced problems with violations of City fire codes at the present establishments; and, 17 WHEREAS, to fully review these issues with appropriate input from the Department of 18 Planning and Development, the Little Rock Police Department, the Little Rock Fire Department, 19 the Planning Commission, the public, and any other appropriate sources of information; 20 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF 21 THE CITY OF LITTLE ROCK, ARKANSAS: 22 Section 1. A moratorium for a period of six (6) months from the date of passage and publica- 23 tion of this resolution is in effect and no applications, new or pending at any stage of the plan - 24 ning process, shall be granted for a business that will be a special events center as that term is 25 currently used by the Department of Planning & Development. 26 Section 2. During the period of this moratorium, the City Manager is directed to assure that 27 the parameters of a use of property as a special events center are fully explored with the Depart- 28 ment of Planning and Development, the Little Rock Police Department, the Little Rock Fire De- 29 partment, the Planning Commission, the public, and any other interested entities or 30 and to prepare an ordinance for consideration by the Board of Directors. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adju- dication shall not affect the remaining portions of the resolution which shall remain in full force and ef- fect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the resolution. Section 4. Repealer. All resolutions and other matters in conflict with this resolution are hereby repealed to the extent of any consistency.
