3 A RESOLUTION TO ACCEPT TITLE TO PROPERTY DONATED TO THE
4 CITY OF LITTLE ROCK BY WARRANTY DEED, TO BE USED FOR EXPAN-
5 SION OF ROSEDALE PARK; AND FOR OTHER PURPOSES.

7 WHEREAS, an important revitalization goal identified in the City- approved John Barrow Neighbor -
8 hood Action Plan is to provide for more parks and playgrounds in the area, and
9 WHEREAS, Habitat for Humanity has indicated its desire to donate 0.75 acres to the City of Little
10 Rock to contribute toward a buffer to Rosedale Park when planned development of a first -class ball com-
11 plex and community center is realized, and
12 WHEREAS, the City wishes to accept the property for use in the neighborhood revitalization effort;
13 and
14 WHEREAS, in consideration for the donation of the property for the public purpose of
15 neighborhood revitalization, the City has agreed to be responsible for the cost of the appraisal of the
16 property, the environmental assessment, the title search and closing costs, up to a maximum of Four
17 Thousand Dollars ($4,000.00) for all such costs taken together as a whole, and
is WHEREAS, funds to pay the above listed costs are available in 2009 Bond Issuance Account No.
19 605459- B45P010, and
20 WHEREAS, state law requires that the City accept the property by a resolution adopted by the Board
21 of Directors;
22 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
23 OF LITTLE ROCK, ARKANSAS:
24 Section 1. The Board of Directors hereby accepts the proposed donation, subject to the appraisal,
25 environmental assessment and title search.
26 Section 2. The property shall be used for a public purpose, specifically for a City neighborhood re-
27 vitalization program.
28 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
29 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
30 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
31 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
32 ordinance.

33 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsist -W-f i
34 the provisions of this resolution are hereby repealed to the extent of such inconsistency.
