RESOLUTION NO. 13,077
3 A RESOLUTION TO AUTHORIZE THE MAYOR AND THE CITY
4 CLERK TO EXECUTE A TEMPORARY CONSTRUCTION EASEMENT
5 LOCATED ALONG A PORTION OF STAGECOACH ROAD IN THE
6 CITY OF LITTLE ROCK, ARKANSAS, TO THE ARKANSAS HIGHWAY
7 AND TRANSPORTATION DEPARTMENT FOR A ROADWAY
8 IMPROVEMENT PROJECT; AND FOR OTHER PURPOSES.

10 WHEREAS, the Arkansas Highway and Transportation Department is undertaking a street
11 widening project along State Highway 5, Stagecoach Road between Otter Creek and the County
12 Line, which will necessitate the reconstruction of driveways on land owned by the City at Otter
13 Creek Park, and
14 WHEREAS, the Arkansas Highway and Transportation Department has requested
15 temporary construction easements from the City to accomplish the construction; and
16 WHEREAS, the project will be a benefit to the City and its citizens.
17 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
18 THE CITY OF LITTLE ROCK, ARKANSAS:
19 Section 1. The Mayor and City Clerk are hereby authorized to execute temporary
20 construction easements, in the form provided in the attachment and as shown on Arkansas
21 Highway and Transportation Department construction plans for Job No. 061202, for the
22 construction of the street improvement project.
23 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause,
24 phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such
25 declaration or adjudication shall not affect the remaining portions of the resolution which shall
26 remain in full force and effect as if the portion so declared or adjudged invalid or
27 unconstitutional were not originally a part of the resolution.
28 Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that are
29 inconsistent with the provisions of this resolution, are hereby repealed to the extent of such
30 inconsistency.
