4 DEVELOPMENT AND ESTABLISH A PLANNED OFFICE DISTRICT
5 TITLED KIRKPATRICK PLAZA SHORT -FORM POD (Z- 5243 -B),
6 LOCATED ON THE SOUTHWEST CORNER OF BIRCHWOOD DRIVE
7 AND SHACKLEFORD ROAD, LITTLE ROCK, ARKANSAS, CIRCO,
8 AMEND THE OFFICIAL ZONING MAP OF THE CITY OF LI p ®�
9 ROCK, ARKANSAS; AND FOR OTHER PURPOSES.

11 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTirS n
12 THE CITY OF LITTLE ROCK, ARKANSAS:
13 Section 1. That the zoning classification of the following described property be changed
14 from R -2, Single - Family, to POD:
15 Lots 37 and 38 Birchwood Addition, Little Rock, Pulaski County, Arkansas.
16 Section 2. That the approval of Kirkpatrick Plaza Short-Form POD (Z- 5243 -B), located on
17 the southwest corner of Birchwood Drive and Shackleford Road, is subject to compliance with
18 the following additional conditions:
19 That the preliminary site development plan/plat be approved as submitted,
20 including all staff comments and conditions as outlined in the Planning
21 Commission Agenda Staff Report in paragraphs D, E, F and including any
22 conditions indicated in the staff analysis in paragraph H and subject to additional
23 conditions imposed at the Planning Commission Public Hearing as amended by
24 the applicant.
25 Section 3. That the preliminary site development plan/plat be approved as recommended by
26 the Little Rock Planning Commission.
27 Section 4. That the change in zoning classification contemplated for Kirkpatrick Plaza Short-
28 Form POD (Z- 5243 -B), located on the southwest corner of Birchwood Drive and Shackleford
29 Road, is conditioned upon obtaining a final plan approval within the time specified by Chapter
30 36, Article VII, Section 36 -454 (e) of the Code of Ordinances.

Section 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of
Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in
the respects necessary to affect and designate the change provided for in Section 1 hereof.
Section 6. That this Ordinance shall not take effect and be in full force until the final
approval of the plan.
Section 7. Severability. In the event any title, section, paragraph, item, sentence, clause,
phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such
declaration or adjudication shall not affect the remaining portions of the ordinance which shall
remain in full force and effect as if the portion so declared or adjudged invalid or
unconstitutional were not originally a part of the ordinance.
Section 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are
inconsistent with the provisions of this ordinance are hereby repealed to the extent of such
inconsistency.
