4 SIXTEEN (16) -FOOT WIDE ALLEY RIGHT -OF -WAY (BLOCK
5 BOUNDED BY WEST I1TH STREET, MARYLAND AVENUE, BOOKER
6 STREET AND JOHNSON STREET), LOCATED WITHIN BLOCK "" W' C/�

8 ROCK, ARKANSAS; AND FOR OTHER PURPOSES.

10 WHEREAS, a request was made to vacate and abandon the South 82.7 feet of the sixteen (16 }' -'foot
11 wide alley right of way (block bounded by West 11`h Street, Maryland Avenue, Booker Street and
12 Johnson Street) located within Block 2, Jones and Worthen's Addition to the City of Little Rock,
13 Arkansas, pursuant to the City's general police power authority under Ark. Code Ann. § 14 -54 -104; and
14 WHEREAS, the Board has determined that the abandoning of this public right -of -way will not have
15 an adverse impact on the public welfare and safety, and therefore, the alley right -of -way abandoned by
16 this ordinance is no longer needed for corporate purposes, except as otherwise noted below;
17 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
18 OF LITTLE ROCK, ARKANSAS:
19 Section 1. The Board of Directors hereby releases, vacates, and abandons the South 82.7 feet of the
20 sixteen (16) -foot wide alley right of way (block bounded by West 11`h Street, Maryland Avenue, Booker
21 Street and Johnson Street) located within Block 2, Jones and Worthen's Addition to the City of Little
22 Rock, Arkansas.
23 Section 2. The City specifically reserves the public utility easement.
24 Section 3. If the alley is proposed to be fenced or gated, a turnaround must be provided for vehicle
25 tun movements.
26 Section 4. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate
27 records of the recorder of the Circuit Clerk in ex officio recorder of Pulaski County, Arkansas.
28 Section 5. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
29 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
30 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
31 effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part
32 of the ordinance.
33 Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are
I inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
