,0 ORDINANCE TO APPROVE A PLANNED ZONING
DEVELOPMENT AND TO ESTABLISH A PLANNED COMMERCIAL
5 DISTRICT TITLED INDEPENDENT HOTEL PINE STREET SHORT -
6 FORM PCD (Z- 2940 -A), LOCATED ON THE SOUTHEAST CORNER OF
7 WEST 8TH AND PINE STREETS, LITTLE ROCK, ARKANSAS,
8 AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF LITTLE
9 ROCK, ARKANSAS; AND FOR OTHER PURPOSES.

11 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
12 OF LITTLE ROCK, ARKANSAS:
13 Section 1. That the zoning classification of the following described property be changed from 0-3,
14 General Office District, to PCD:
15 The west five (5) feet of Lot 3, and all of Lots 4, 5 and 6 of Block 2, Forest Hill Addition
16 to the City of Little Rock, Pulaski County, Arkansas. Except that part thereof conveyed
17 to the City of Little Rock for street right -of -way, all being more particularly described as
18 follows: Commencing at the northwest corner of Block 2, Forest Hill Addition run thence
19 N89 °42'35 "E for 52.0 feet to the point of beginning; thence continue N89 042'35 "E along
20 the south right -of -way line of West 8`" Street for 91.26 feet; thence S01 °17'26 "E for
21 129.93 feet to the south line of said Lot 3; thence S89 °49'53 "W for 140.12 feet to a point
22 on the east right -of -way line of South Pine Street; thence along said right -of -way line the
23 following: N00 °27'38 "W for 4.47 feet; thence N89 024'47 "E for 8.01 feet; thence
24 N01 043'22 "W for 66.19 feet; thence NO2 °43' 18 "W for 33.69 feet; thence N47 °03' 14 "E
25 for 24.80 feet; thence N66 053'08 "E for 21.88 feet to the point of beginning; AND ALSO
26 all of Lots 1 and 2 and the East 41 feet of Lot 3 said Forest Hill Addition.
27 Section 2. That the approval of Independent Hotel Pine Street Short-Form PCD (Z- 2940 -A), located
28 on the southeast corner of West 8"' and Pine Streets, is subject to compliance with the following
29 additional conditions:
30 That the preliminary site development plan/plat be approved as submitted, including all
31 staff comments and conditions as outlined in the Planning Commission Agenda Staff
32 Report in paragraphs D, E, F and including any conditions indicated in the staff analysis

I in paragraph H and subject to additional conditions imposed at the Planning Commission
2 Public Hearing as amended by the applicant.
3 Section 3. That the preliminary site development plan/plat be approved as recommended by the
4 Little Rock Planning Commission.
5 Section 4. That the change in zoning classification contemplated for Independent Hotel Pine Street
6 Short -Form PCD (Z- 2940 -A), located on the southeast corner of West 8`h and Pine Streets, is conditioned
7 upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36 -454
8 (e) of the Code of Ordinances.
9 Section 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little
10 Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects
11 necessary to affect and designate the change provided for in Section 1 hereof.
12 Section 6. That this Ordinance shall not take effect and be in full force until the final approval of the
13 plan.
14 Section 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
15 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
16 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
17 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
18 ordinance.
19 Section 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent
20 with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
