WHEREAS, a request was made to vacate and abandon a portion of the easements retained within the area of the alley right -of -way located in Block 17, Original City of Little Rock, which was abandoned by Ordinance No. 20,249 on April 20, 2010, pursuant to the City's general police power authority under Ark. Code Ann. § 14 -54 -104; and WHEREAS, the Board has determined that the abandoning of this public right -of -way will not have an adverse impact on the adjacent property owners nor the local traffic, and therefore, the street right -of- way abandoned by this ordinance is no longer needed for corporate purposes. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The Board of Directors hereby releases, vacates, and abandons the easements located within the twenty (20) -foot wide alley abandoned by Ordinance No. 20,249, located within Block 17, Original City of Little Rock, Arkansas, less and except the North twenty (20) feet and the South forty (40) feet thereof. Section 2. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate records of the recorder of the Circuit Clerk in ex officio recorder of Pulaski County, Arkansas. Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part of the ordinance. Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
