CODE 4 § 35 -103 (1988); TO INCREASE THE MEMBERSHIP ON THE LITTLE 5 ROCK SANITARY SEWER COMMITTEE TO SEVEN (7) MEMBERS; TO 6 DECLARE AN EMERGENCY; AND FOR OTHER PURPOSES. 7 8 WHEREAS, the City has created a Sanitary Sewer Committee pursuant to the authority granted in 9 Ark. Code Ann. § 14- 235 -206 (West 2004); and, 10 WHEREAS, Little Rock, Ark., Rev. Code § 35 -103 (a) (1988) provides that there will be five (5) 11 members of the Little Rock Sanitary Sewer Committee ( "the Committee "), the City entity responsible for 12 the oversight of Little Rock Wastewater; and, 13 WHEREAS, the Board of Directors believes that an increase in the size of the Committee by two (2) 14 additional members will provide greater citizen participation and more diverse viewpoints on the policy 15 issues involved with the delivery of sewer service to the citizens of the City; 16 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 17 OF LITTLE ROCK, ARKANSAS: 18 Section 1. Little Rock, Ark., Rev. Code § 35 -103 is hereby amended to read as follows: 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 (a) The Sanitary Sewer Committee shall consist of seven (7) members, ap- pointed in accordance with state law, for terms of five (5) years each. (b) The five (5) members of the Committee serving on the effective date of this ordinance shall complete their regular term, and any reappointment (:e k appointment of a successor shall be a full five (5) -year regular term. co (c) The two new members first appointed after the effective date of this oi; dinance shall serve for staggered terms so that in no year will more than '-'-,, two (2) members be appointed to a full five (5) -year term. If' 01111111 (d) Each member shall be an elector citizen of the City. (e) The committee shall perform all the duties of the Sanitary Sewer Com- mittee as set forth in state law and this Code of Ordinances. Section 2. Severability. In the event any section, subsection, subdivision, paragraph, subparagraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconsti- tutional, such declaration or adjudication shall not affect the remaining provisions of this ordinance, as if such invalid or unconstitutional provision were not originally a part of this ordinance. All ordinances, resolutions, bylaws, and other matters inconsistent with this or- dinance are hereby repealed to the extent of such inconsistency. Section 4. Emergency Clause. The need for enhanced citizen input as to the operation of a sanitary sewer system for the City to assure full consideration of various service issues is essential to protect the public health, safety and welfare; the two additional members permitted by this ordinance will only en- hance this input; an emergency is, therefore, declared to exist and this ordinance shall be in full force and effect from and after the date of its passage.
