20404I 2 ORDINANCE NO. 20,404 3 AN ORDINANCE TO AUTHORIZE VARIOUS MEMBERS OF CITY 4 BOARDS AND COMMISSIONS TO CONTRACT WITH THE CITY, AND 5 TO SET THE PARAMETERS OF SUCH CONTRACTS; TO DECLARE AN 6 EMERGENCY; AND FOR OTHER PURPOSES. s WHEREAS, the City appoints volunteer citizens to serve on City Boards and Commissions, 9 and these persons are treated as officers or employees of the City at the time of their appoint - 10 ment, the discussion of which occurs in executive session; and, 11 WHEREAS, Ark. Code Ann. § 14 -47 -137 requires that for any contract to furnish supplies, 12 equipment, or services to the City by an employee or officer, appointed or elected, there must be 13 an ordinance in place to permit such a contract and to prescribe the extent of authority the citizen 14 has under such contract; 15 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF 16 THE CITY OF LITTLE ROCK, ARKANSAS: 17 Section 1. Pursuant to the requirements of Ark. Code Ann. § 14 -47 -137 (a) (West Supp. 18 2010), the Board of Directors authorizes the contracts, and the extent of the authority to contract, 19 by board and commission members set forth in Exhibit A to this ordinance. 20 Section 2. Severability. In the event any section, subsection, subdivision, paragraph, sub - 21 paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be 22 invalid or unconstitutional, such declaration or adjudication shall not affect the remaining provi- 23 sions of this ordinance, as if such invalid or unconstitutional provision were not originally a part 24 of this ordinance. 25 Section 3. Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent with 26 this ordinance are hereby repealed to the extent of such inconsistency. 27 Section 4. Emergency Clause. The need for an ordinance to permit certain citizens to serve 28 on City boards and commissions while at the same time be in a contractual relationship with the 29 City according to state law is essential to the protection of the public health, safety and welfare; 3o an emergency is, therefore, declared to exist and this Ordinance shall be in full force and effect 31 as to any application filed from and after the date of its passage.
