That the zoning classification of the following described property be changed from R -2 to 13 PCD: 14 Part of the NE 1/4 of the SE '/, Township 1 North, Range 14 West, Section 10, Pulaski 15 County, Arkansas, more particularly described as follows: Commence at the NE corner of 16 said NE I/4 SE 1/4 and run thence south 362.0 feet; thence south 54 °00'00 "W 622.0 feet to 17 a point in the centerline of Colonel Glenn Road (Upper Hot Springs Pike), thence south 18 35 °54'00 "E twenty (20) feet to the point of beginning, thence along said centerline, south 19 35 054'00 "E 140.22 feet, thence leaving said centerline north 53 °57'29 "E 125.0 feet, 20 thence north 35 °54100 "W 140.18 feet, thence south 53 °58'48 "W 125.0 feet to the point of 21 beginning, containing 0.40 acres more or less. Also know as part of Tract 6, Marsh 22 Subdivision, Pulaski County, Arkansas. 23 Section 2. That the approval of Evans Short-Form PCD (Z- 8586), located at 19012 Colonel Glenn 24 Road, is subject to compliance with the following additional conditions: 25 That the preliminary site development plan /plat be approved as submitted, including 26 all staff comments and conditions as outlined in the Planning Commission Agenda Staff 27 Report in paragraphs D, E, F and including any conditions indicated in the staff analysis 28 in paragraph H and subject to additional conditions imposed at the Planning Commission 29 Public Hearing as amended by the applicant. 30 The uses allowed for the site are those identified in the C -3, General Commercial 31 Zoning District. Section 3. That the preliminary site development plan/plat be approved as recommended by the Little Rock Planning Commission. Section 4. That the change in zoning classification contemplated for Evans Short-Form PCD (Z- 8586), located at 19012 Colonel Glenn Road, is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances. Section 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof. Section 6. That this Ordinance shall not take effect and be in full force until the final approval of the plan. Section 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the ordinance. Section 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
