CODE §§ 8 -583 4 (d) (e) (1988) TO CHANGE THE TIME FOR RESPONSE AND CORRECTION 5 OF LIFE SAFETY VIOLATIONS, AND OTHER CODE VIOLATIONS ONCE 6 NOTICE HAS BEEN PROVIDED; TO DECLARE AN EMERGENCY; AND 7 FOR OTHER PURPOSES. 8 9 WHEREAS, the City of Little Rock, Arkansas ( "the City ") has exercised its broad authority and po- lo lice powers to establish procedures for inspection, notice, and prosecution, of violations of the various 11 City code enforcement issues with respect to rental units; and, 12 WHEREAS, there are certain violations that are defined as life safety violations which are housing 13 code violations deemed by a building official to constitute an unsafe health condition presenting an im- 14 mediate danger to human health, safety or welfare; and, 15 WHEREAS, both life safety violations, and other non -life threatening violations, should be repaired, 16 or the property brought into compliance, with a reasonable period of time after notice of such a violation; 17 and, 18 WHEREAS, the current time frame for compliance is too long and should be shortened in order to 19 accomplish compliance with City ordinances as quickly as possible, or to allow the City to proceed with 20 appropriate legal action for the violation of City codes; 21 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 22 OF LITTLE ROCK, ARKANSAS: 23 Section 1. Little Rock, Ark., Rev. Code § 8 -583 (d) is hereby amended to read: 24 The owner shall complete code compliance for life safety violations within seven 25 (7) days of the notification by the city. The city shall not issue a certificate of com- 26 pliance until any violations listed in the notice are corrected. 27 Section 2. Little Rock, Ark., Rev. Code § 8 -583 (e) is hereby amended to read: 28 If a good faith effort is demonstrated, all life safety violations were corrected 29 within seven (7) days of the notification by the city, and there is consistent and 30 continuous progress shown, the building code official may grant an extension for 31 repair of all non -life safety violations from thirty (30) days to a time not to exceed 32 sixty (60) days from the notification by the City. The City shall not issue a certifi- 33 cate of compliance until any violations listed in the notice are corrected. 34 Section 3. Little Rock, Ark., Rev. Code § 8 -579 (d)(4) is hereby amended to read: IPAGE 1 of 21 Ordinance to amend time frame for response to life safety violation; and for other violations; find, to declare an emergency 1 The owner shall come into compliance with the provisions of this ordinance 2 within the folloding timelines measured from the date the notice is served by the 3 city: 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 (a) Teri (10) business days to designate an agent as directed by this ordnance; or, (b) Seven (7) days allowed under subsection 8- 583(d) to correct life safety violations; (c) Thirty (30) days, or such lesser time allowed, pursuant to the spe ial provisions of subsection 8- 583(e) to correct all non -life safety, non -life threatening violations; provided, that in appro- priate circumstances as set forth in this ordinance, the building inspector may extend the time to sixty (60) days pursuant to § 8- Section 4. Severabilit . In the event any section, subsection, subdivision, paragraph, subparagraph, item, sentence, clause, pbrat e, or word of this ordinance is declared or adjudged to be invalid or unconsti- tutional, such declaration or adjudication shall not affect the remaining provisions of this ordinance, as if such invalid or unconstitutic nal provision were not originally a part of this ordinance. Section S. Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent with this ordinance are hereby repealed to the extent of such inconsistency. Section 6. Emergency Clause. The requirement that rental properties comply with life safety, or other code violations, as qu ckly as possible, is essential to preserve the public health, safety and welfare; the amendments set forth in this ordinance demonstrate that the correction of these violations should be on a more strict time frame (han that currently in place; an emergency is, therefore, declared to exist and this Ordinance shall be in f ll force and effect from and after the date of its passage.
