20314I ORDINANCE, NO. 20.314 1 ORDINANCE NO. 20,314 2 PULASKI COUNTY CIRCUIT %COUNTY CLERK 2010056743 Received: 9/14/2010 1:58:33 PM Recorded: 09/14/2010 02:04:07 PN1 Filed & Recorded in Official Records of PAT O'BRIEN, PULASKI COUNTY CIRCUIT %COUNTY CLERK Fees $20.00 3 AN ORDINANCE TO ABANDON THE SIXTY (60) -FOOT WIDE ACCESS 4 EASEMENT LOCATED BETWEEN LOTS 1 AND 20, COLONEL GLENN 5 CENTRE, SOUTH OF COLONEL GLENN SQUARE (G -24 -028), IN THE CITY 6 OF LITTLE ROCK, ARKANSAS; AND FOR OTHER PURPOSES. 7 WHEREAS, a request was made to vacate and abandon the sixty (60) -foot wide access easement 8 located between Lots 1 and 20, Colonel Glenn Centre, South of Colonel Glenn Square, in the City of 9 Little Rock, Arkansas, pursuant to the City's general police power authority under Ark. Code Ann. § 14- 10 54 -104; and 11 WHEREAS, the Board has determined that the abandoning of this public right -of -way will not have 12 an adverse impact on the adjacent property owners and, therefore, the easement abandoned by this 13 ordinance is no longer needed for corporate purposes, except as otherwise noted below; 14 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 15 OF LITTLE ROCK, ARKANSAS: 16 Section 1. The Board of Directors hereby releases, vacates, and abandons the sixty (60) -foot wide 17 access easement located between Lots 1 and 20, Colonel Glenn Centre, South of Colonel Glenn Square, 18 in the City of Little Rock, Arkansas. 19 Section 2. The City specifically reserves the public utility and drainage easements. 20 Section 3. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate 21 records of the recorder of the Circuit Clerk in ex officio recorder of Pulaski County, Arkansas. 22 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 23 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 24 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 25 effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part 26 27 28 29 30 31 32 33 34 of the ordinance. Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
