202891 ORDINANCE NO. 20,289 2 3 AN ORDINANCE TO AMEND LITTLE ROCK, ARK. ORDINANCE NO. 20,204 4 (DECEMBER 15, 2009), TO ADJUST THE FISCAL YEAR 2010 BUDGET ORDI- 5 NANCE TO REFLECT REVENUE AND EXPENDITURE ADJUSTMENTS FOR 6 THE GENERAL FUND, STREET FUND, RIVER MARKET FUND, AND THE 7 JIM DAILEY FITNESS AND AQUATIC CENTER; TO DECLARE AN EMER- 8 GENCY; AND FOR OTHER PURPOSES. 9 10 WHEREAS, the City approved a comprehensive budget for the City of Little Rock, Arkansas, in Lit - 11 tle Rock, Ark., Ordinance No. 20,204 (December 15, 2009), and 12 WHEREAS, it is appropriate to adjust the ordinances to reflect operational changes in the General 13 Fund, and where necessary to authorize the increase or decrease in the fiscal year 2010 line items for 14 these and other matters, and 15 WHEREAS, the City Manager and the Director of Finance & Treasurer, in compliance with City 16 budget and financial reporting policies, have reviewed these adjustments and recommend them to the 17 Board of Directors for approval, 18 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 19 OF LITTLE ROCK, ARKANSAS: 20 Section 1. General Fund. Section 5 of Little Rock, Ark., Ordinance No. 20,204 (December 15, 21 2009) is hereby amended so the General Fund Operating Resources amount will decrease by Two Million 22 Two Hundred Ninety -Two Thousand Seven Hundred and Fifty -Six Dollars ($2,292,756) to the amount of 23 One Hundred Twenty Eight Million Eight Hundred Fifty -Six Thousand Six Hundred Nineteen Dollars 24 ($128,856,619) to reflect reductions in operating budgets for General Fund Departments of Four Hundred 25 Ten Thousand, Six Hundred One Dollars ($410,601), to the amount One Hundred Thirty Million, Seven 26 Hundred Thirty-Eight Thousand, Seven Hundred Seventy -Four Dollars ($130,738,774). 27 Section 2. Street Fund. Section 5 of Little Rock, Ark., Ordinance No. 20,204 (December 15, 2009) 28 is hereby amended so the Street Fund Operating Resources amount will decrease by One Hundred Fifty - 29 Five Thousand, One Hundred Eighty -Seven Dollars ($155,187) to Fourteen Million, Six Hundred and 30 Eighteen Thousand, Three Hundred Fifty -Five Dollars ($14,618,355), to reflect an increase in operating 31 budgets for Street Fund departments of One Hundred Twenty -Two Thousand, Eight Hundred Thirteen 32 Dollars ($122,813), to the amount of Fifteen Million, Two Hundred Twenty -One Thousand, Three Hun - 33 dyed Fifty -Five Dollars ($15,221,355). 34 Section 3. River Market Fund. Section 5 of Little Rock, Ark., Ordinance No. 20,204 (December 15, 35 2009) is hereby amended so the River Market Fund Operating Resources amount will increase by Five (PAGE 1 OF 2] Ordinance to amend Little Rock, Ark., Ordinance No. 20,204 (December 1.1, 2009) to adjust the 2010 City budget I Hundred Fifty Thousand Dollars ($550,000) to Eight Hundred Thousand Dollars ($800,000), to reflect an 2 increase in operating budgets for River Market Fund departments of Eight Hundred Thousand Dollars 3 ($800,000), to the amount of Eight Hundred Ninety -Six Thousand, Seven Hundred Forty -One Dollars 4 ($896,741). 5 Section 4. Jim Dailey Fitness and Aquatic Center. Section 5 of Little Rock, Ark., Ordinance No. 6 20,204 (December 15, 2009) is hereby amended so the Jim Dailey Fitness and Aquatic Center operating 7 budget reflects an increase of One Hundred Fifteen Thousand Dollars ($115,000), to the amount of One 8 Million, Two Hundred Fifty -Two Thousand, Four Hundred Eleven Dollars ($1,252,411). 9 Section 5. Records. The Director of Finance & Treasurer is directed to maintain appropriate records 10 which provide greater detail for the adjustments set forth in this ordinance as reflected in the materials 11 provided to the Board of Directors for the July 6, 2010, meeting. 12 Section 6. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 13 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adju- 14 dication shall not affect the remaining portions of the ordinance which shall remain in full force and effect 15 as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordi- 16 nance. 17 Section 7. Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent with this 18 ordinance are hereby repealed to the extent of such inconsistency including, but not limited to, Little 19 Rock, Ark., Ordinance No. 20,204 (December 15,2009). 20 Section 8. Emergency. The City's ability to properly maintain its budgets and to account for its 21 funds is essential to maintain the public health, safety and welfare; an emergency is, therefore, declared 22 to exist and this ordinance shall be in full force and effect from and after the date of its passage. 23 24 25 26 27 28 PASSED: July 6, 2010 29 APPROVED AS TO LEGAL FORM: 30 /? 31 L" 32 Thomas M.
