3 AN ORDINANCE TO DISPENSE WITH THE REQUIREMENT OF COMPETI-
4 TIVE BIDDING AND TO AUTHORIZE THE CITY MANAGER TO ENTER
5 INTO A CONTRACT IN THE AMOUNT OF FOUR HUNDRED NINETY -EIGHT
6 THOUSAND, FOUR HUNDRED FORTY -SIX AND 46/100 DOLLARS
7 ($498,446.46), WITH MOTOROLA, INC., AS THE SOLE SOURCE PROVIDER,
8 FOR THE PURCHASE OF TWENTY -FOUR (24) PORTABLE RADIOS AND
9 FOR SOFTWARE UPGRADES TO THE COMMUNICATION NETWORK; AND
10 FOR OTHER PURPOSES.

12 WHEREAS, the Little Rock Police Department needs twenty -four (24) Motorola portable police ra-
13 dios to replace worn units and for spares in emergencies and to contract with Motorola for software up-
14 grades to the communications network.
15 WHEREAS, Motorola is the sole supplier, of radio equipment for the City of Little Rock and com-
16 petitive bidding should be waived and the contract awarded to Motorola, Inc., as the sole source provider
17 for the purchase of twenty -four portable radios in the amount of Ninety -Four Thousand, Eight Hundred
18 Seventy -Six and 98/100 Dollars ($94,876.98), and for software upgrades to bring all units into compli-
19 ance with PR25 requirements in the amount of Four Hundred Three Thousand, Five Hundred Sixty -Nine
20 and 48/100 Dollars ($403,569.48), for a total cost of Four Hundred Ninety -Eight Thousand, Four Hun-
21 dred Forty-Six and 46/100 Dollars ($498.446.46).
22 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
23 OF LITTLE ROCK, ARKANSAS:
24 Section 1. The Board of Directors finds that because of the longstanding reliance upon Motorola
25 equipment for police communication equipment it is impractical and unfeasible to engage in competitive
26 bidding, the purchase of twenty -four (24) portable police radios and software upgrades to the communica-
27 tions network for the Police Department shall be accomplished with the occurrence of such bidding. .
28 Section 2. The City Manager is hereby authorized to enter into a contract with Motorola, Inc.., for
29 the purchase of twenty -four (24) portable police radios and for software upgrades to the communications
30 network of the Little Rock Police Department, for a total cost of Four Hundred Ninety -Eight Thousand,
31 Four Hundred Forty -Six and 46/100 Dollars ($498.446.46).
32 Section 3. Funds for this purchase are available from the 2009 COPS Technology Grant.
33 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
34 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adju-

Section 5. Repealer. All ordinances and resolutions, and parts thereof, which are in conflict with
any provision of this ordinance are hereby repealed to the extent of such conflict.
