20268�$,qy QSiE ?9if BFq FF ` 2010029063 Received: 6119)2010 3 :29:17 Phil R 6 �;, Recorded: 0a11912010 033 36:20 P filed recorded in Off icial Records of PT O'BRIE. 1 taw ORDINANCE NO. 20,2 LASK1 COUNTY CIRCUi iJ�C`t1dV3 °( CLERK es $30.00 2�� 3 AN ORDINANCE TO CONDEMN CERTAIN STRUCTURES IN THE 4 CITY OF LITTLE ROCK AS STRUCTURAL, FIRE AND HEALTH 5 HAZARDS; TO PROVIDE FOR SUMMARY ABATEMENT 6 PROCEDURES; TO DIRECT THE CITY ATTORNEY TO TAKE SUCH 7 ACTION AS IS NECESSARY TO RAZE AND REMOVE SAID 8 STRUCTURES; TO DECLARE AN EMERGENCY; AND FOR OTHER 9 PURPOSES. 10 11 WHEREAS, certain structures in the City of Little Rock, Arkansas, have become run -down, 12 dilapidated, unsightly, dangerous, obnoxious and detrimental to the public welfare of the citizens 13 of Little Rock; and 14 WHEREAS, the condition of these structures constitutes a serious structural, fire and health 15 hazard; and 16 WHEREAS, such structures are a public nuisance and are dangerous to the health and safety 17 of the occupants or other persons and, further, are in such condition as to be dangerous to the 18 lives, limbs and property of people in its vicinity or those lawfully passing thereby; and 19 WHEREAS; such structures are declared a nuisance and immediate action is necessary to 20 remedy these situations and said buildings should be rehabilitated by the owners or razed either 21 by the owners or the City of Little Rock; 22 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF 23 THE CITY OF LITTLE ROCK, ARKANSAS. 24 Section 1. The Board of Directors hereby declares that the following structures constitute 25 public nuisances. The owners of the following described properties are hereby ordered either to 26 begin rehabilitation by immediately contacting the Department of Housing & Neighborhood 27 Programs and entering into an agreement providing for the immediate rehabilitation of the 28 structures or to raze and remove said structures within twenty -four (24) hours and to complete 29 such removal within seventy -two (72) hours of the effective date of this Ordinance. The conditions of the structure on the above - described property have been found to present structural, fire and health hazards and are dangerous to the health and safety of the occupants or other persons, and further, the structures are in such condition as to be dangerous to the lives, limbs and property of people in its vicinity or those lawfully passing thereby. Section 3. The City Manager is hereby authorized to institute such proceedings against such persons as may be necessary in order to enforce the provisions of this ordinance so as to remedy the unsightly and dangerous conditions brought about as a result of the failure of the owners thereof to maintain this property. Section 4. The Department of Housing and Neighborhood Programs of the City of Little Rock is also authorized to raze and remove said buildings and file and enforce a lien against said [PAGE 3 OF 4] I property for the cost of razing and removing said structures pursuant to Section 20 -32 of the 2 Little Rock Code of Ordinances. 3 Section 5.
