3 AN ORDINANCE TO ABANDON EASEMENTS RETAINED IN
4 FORMERLY ABANDONED RIGHTS -OF -WAY OF PORTIONS OF
5 WEST 31" STREET AND FILLMORE STREET; AND TO ABANDON
6 A SEWER EASEMENT LOCATED IN BLOCKS 7, 8 AND 15, C.O.
7 BRACK ADDITION; AND FOR OTHER PURPOSES.
8 WHEREAS, a request was made to vacate and abandon easements retained in formerly
9 abandoned rights -of -way of portions of West 31St Street and Fillmore Street and to abandon a
10 sewer easement located in Blocks 7, 8 and 15, C.O. Brack Addition to the City of Little Rock,
11 pursuant to the City's general police power authority under Ark. Code Ann. § 14 -54 -104; and
12 WHEREAS, the Board has determined that the abandoning of this public right -of -way will
13 not have an adverse impact on the adjacent property owners nor the local traffic, and therefore,
14 the easements abandoned by this ordinance are no longer needed for corporate purposes, except
15 as otherwise noted below;
16 NOW, THEREFORE, BE IT ORDAINED. BY THE BOARD OF DIRECTORS OF
17 THE CITY OF LITTLE ROCK, ARKANSAS:
18 Section 1. The Board of Directors hereby releases, vacates, and abandons the following
19 described easements, subject to the abandonment not becoming effective until any existing
20 utilities are removed or relocated and new easements are dedicated for relocation:
21 A 20 -foot easement being the West' /2 of 31St Street closed by Ordinance No.
22 12,123, between Blocks 8 and 15, C.O. Brack Addition, City of Little Rock,
23 Pulaski County, Arkansas, as filed for record in Plat Book 1, Page 166;
24 AND
25 A 20 -foot easement being Fillmore Street closed by Ordinance No. 12,205, along
26 Lots 5 and 6, Block 8, C.O. Brack Addition, City of Little Rock, Pulaski County,
27 Arkansas, as filed for record in Plat Book 1, Page 166, and extending South to the
28 centerline of West 31 St Street closed by Ordinance No. 12,123.
29 AND
30 A sanitary sewer easement over Lots 1 -4, Block 15, and Lot 7, Block 7, and Lots
31 5 -10, Block 8, C.O. Brack Addition as filed for record in Deed Book 251, Page
32 79, that is blanket in nature.

To abandon easements within Block 17, Original City of Little Rock
I Section 2. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the
2 real estate records of the recorder of the Circuit Clerk in ex officio recorder of Pulaski County,
3 Arkansas.
4 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause,
5 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such
6 declaration or adjudication shall not affect the remaining portions of the ordinance which shall
7 remain in full force and effect as if the portion so declared or adjudged to be invalid or
8 unconstitutional were not originally a part of the ordinance.
9 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same that are
10 inconsistent with the provisions of this ordinance are hereby repealed to the extent of such
