202493 AN ORDINANCE TO ABANDON THE TWENTY (20)- FOOT -WIDE 4 ALLEY RIGHT -OF -WAY LOCATED WITHIN BLOCK 17, ORIGINAL 5 CITY OF LITTLE ROCK (BLOCK BOUNDED BY MAIN STREET, 6 SCOTT STREET, EAST 16TH STREET AND EAST 17TH STREET); 7 AND FOR OTHER PURPOSES. 8 WHEREAS, a request was made to vacate and abandon the twenty (20)- foot -wide alley 9 right -of -way located within Block 17, Original City of Little Rock (block bounded by Main 10 Street, Scott Street, East 16th Street and East 17th Street), pursuant to the City's general police 11 power authority under Ark. Code Ann. § 14 -54 -104; and 12 WHEREAS, the Board has determined that the abandoning of this public right -of -way will 13 not have an adverse impact on the adjacent property owners nor the local traffic, and therefore, 14 the easements abandoned by this ordinance are no longer needed for corporate purposes, except 15 as otherwise noted below; 16 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF 17 THE CITY OF LITTLE ROCK, ARKANSAS: 18 Section 1. The Board of Directors hereby releases, vacates, and abandons the twenty (20)- 19 foot -wide alley right -of -way located within Block 17, Original City of Little Rock (block 20 bounded by Main Street, Scott Street, East 16tl' Street and East 17th Street), as public right -of- 21 way. 22 Section 2. The City specifically reserves the public utility and drainage easements. 23 Section 2. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the 24 real estate records of the recorder of the Circuit Clerk in ex officio recorder of Pulaski County, 25 Arkansas. 26 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, 27 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such 28 declaration or adjudication shall not affect the remaining portions of the ordinance which shall 29 remain in full force and effect as if the portion so declared or adjudged to be invalid or 30 unconstitutional were not originally a part of the ordinance. 31 Section 4. Repealer.
